  • Having DWI trials while we are waiting on interview

    Hi Everyone. I married to my wife who is USC. My PD was 8/4/2017, I had my EAD October/2017 and I just submitted for EAD renewal and we are still waiting on interview. My field office is Dallas, TX. A couple months back, my wife was arrested for speeding and alcohol breath 1.6. Her driver license was suspended. Now, the other lawyer (not immigration lawyer) is still working on her case.
    Question1 , is this going to effect our i485 case? Should it be a reason of waiting this long for interview? What should I do?
    Question 2, has anyone in Dallas been waiting for interview since last year?
    Please help.

    The petitioner's trials shouldn't be relevant to the beneficiary's immigration.

      Talk to both an immigration lawyer and a criminal lawyer. Here's the reason why.

      A plea of deferred adjudication in immigration terms means guilty. The outcome of your criminal trial can have an affect on your immigration matter. A LOT of people take deferred adjudication through the advise of their lawyers who typically aren't immigration lawyers and that ends up making them deportable. Do not take this advise lightly.

      Feb 2017 - RFE received
      March 2017 - Biometrics completed
      April 2017 - RFE response received case no longer on hold
      April 2017 - Case is being scheduled for interview
      May 2017 - AP/EAD received:
      March 2018 - AP/EAD forms sent for renewal
      Sept 2018 - AOS interview scheduled.
      Oct 2018 - AOS interview
      Nov 2018 - Green card in hand

        Your wife is the USC, you are the beneficiary if I read this correctly. Therefore there shouldn't be a problem. They are concerned about your character and your background, not that of the USC.
        Marriage AOS - 2018

        4-10: Sent to Chicago Lockbox
        4-12: Arrived in Chicago
        4-14: Picked up by USCIS
        4-19: Email & text notifications received
        4-23: I-797 Receipts received
        4-27: Biometrics notice received
        5-10: Courtesy letter for I-693
        5-11: Biometrics completed
        6-04: Interview scheduled
        6-09: Received interview letter
        7-10: Interview complete & approved, status change to New Card being Produced
        7-13: Card was Mailed
        7-18: Green Card in Hand

          Hi, I also don?t think this is what has resulted in the long delay of your interview. I submitted mine in October 3 , 2017. And I got my EAD in January of this year2018. I?ve still not heard anything from them. I?m also filing from Dallas Texas.

              My mistake there. I misread it and thought you were the applicant. If your wife has a DWI it's got no standing on you so you should be fine.

                You will be fine. The important thing is your background, not your wife.
