Seeking advice regarding my immigration process

    I was afraid of that. Even if we file it now and move she has to take care of her Dad so that would mean she cant work full time and when the interview comes around she wont be able to show income like she makes now.

      It's possible for her to count the income of someone else in her household, e.g. if she lives with her parents and her parents have income. It's also possible to get a joint sponsor whose household income is enough, who is willing to fill out a second I-864.

        We would be living with her Dad and he has retirement income. Would he then need to complete the i-864 OR would he just be listed on the form showing the household income?
        We really dont know anyone else who could co sponsor and we dont want her Dad to be going through all this having to get forms together as it will just cause him stress.


        EDIT... found the answer, they must complete i-864a and submit the required forms...that wont work for us then, her Dad is stressed enough with whats hes dealing with.

          P. D 18th April, 2018.
          No update on USCIS application. I received a pink courtesy letter requesting that I bring a completed and signed I-693 if I receive interview notice in the mail. I have waited for so long, I wonder if this is a sign that I will receive my EAD soon.
          I have called the Immigration officer, not much help except to say my application is in process.

            Thats good news cvo041218. I am shocked you have been waiting to work since April though! Thats a long time for an EAD. I really hope mine dosent take so long.

            Does anyone know if I could include myself on the i-864a form if I can find a cash job or start my own business to supplement the household income?
            I'm starting to worry about applying now, and when/if I will be able to just because my fiancee wont be able to show much income when we move to Texas to take care of her father and we dont know anyone to co sponsor. The part where it asks for tax returns I just write I have not filed any taxes?

              Your (the intending immigrant's) income can be included in a sponsor's household income, without needing to fill out an I-864A, but only if you are working legally in the US. Since you are overstaying, you cannot work legally in the US, until you get an EAD or green card.

                Newacct - Thank you for sharing your knowledge on this forum, you are truly a huge help!

                To keep picking your brain what happens if we file whilst here in Colorado because she makes great money and can easily show support on the i-864, then we move to Texas but she keeps her job open in Colorado on away status for 6 months whilst she takes care of her father and just in case we return to Colorado ? Filing a change of address for the petitions when we move south. Would the income requirements be "as when applied" or would she need to show the x amount of months at the interview from the dates we moved to Texas.

                  Both. She should have that much current income when she files (since she swears that that information is true), and they will ask her at the interview if she has changed jobs, and if so, they will ask for a new I-864 showing a sufficient income from her then.

                    I think we have sorted this out, we will file whilst here in Denver as she can show she is still working and once we move towards the end of the year we can file the change of address forms, have the interview in Dallas and she can get an affidavit signed by her father because he is actually going to pay her each month for home care instead of him having to pay a company to come out and take care of him. I think that will work, she can show income now and then income once we move.
