Help: Employment termination while L1 to Adjustment of Status I-485

    Hi All,

    fist of all thank you to everyone who's helping and giving advices on this website, all information are so helpful, you people are amazing.

    Well, I'm on L1-B Visa currently, but my employment is very close to an end due internal changes.

    I got married in May and submitted all documentation to USCIS in June for the adjustment of status I-485, along with I-130, I-131, I-767,
    supported by the company lawyers. My I-94 (L1 based) is valid until May 2019, not sure if that matters at this point.

    Now, assuming my L1 status drops due employment termination, what's happening to my GC through marriage petition? What should I do?
    Can I simply stay at home here in the U.S. waiting to get the EAD while my case is being processed, or do I need to take other actions? The company lawyers won't support me anymore obviously, but I hope they can't take my case down from the USCIS while everything has been already submitted and received.


    Thanks for sharing your insights, as you can imagine I'm going through a stressful phase right now, but still hopeful things will be okay.

    You need not do anything regarding your marriage based petition. Once filed, it remains filed unless you withdraw it. See to it that you will be receiving all correspondence from USCIS, since your lawyers would no longer take care of that for you.

      Hey Luke,

      Don't stress at all - I am in exactly the same position. My current L1 Visa expires on Monday, but I haven't yet received my EAD through the AOS application so I'll have to resign from my position until the EAD comes through.

      The L1 visa and the AOS are two different processes. Losing your job with your L1B employer won't impact your green card application as long as it was submitted through marriage, and the company lawyers have no power to influence your AOS application. You will still be perfectly legal to remain in the US while the AOS is waiting decision. You won't be able to work for another company until the EAD is approved, but you're more than safe to stay at home and wait the process out.

        Hi Luke,

        As your AOS application is Marriage based, you can continue to stay in US.

        Once you have your EAD, you can look for other jobs.

        I am sure you will be able to find one.

          First off, rather strange the company lawyers agreed to lead the AOS filing. I would let them know that you want all your paperwork sent back to you and that you will fill out a new G-28 to mention they do not represent you anymore. You do not want the company lawyers to have all that personal information about your and wife's application.

          Next, prepare to look for another job. Once you get near the end of the process you will to push to get an expedite from USCIS/congressman. Usually they put L1 EAD applications at the bottom since you have dual status and are not a priority. So when you are near a job you can push to expedite and explain no longer have status to work or travel.

          The only person that can withdraw your AOS is your wife since she is the petitoner btw.

            Hi guys,

            HUGE thank you to you all who replied so quickly, really appreciate your support and advices...I'm feeling a little less concerned to be honest now.
            Well, I'll continue to have faith while checking the status updates from USCIS.

            Thanks also to Cali2018 for your advice regarding the G-28, extremely important, I didn't think about that.

            Work-wise It's been a little frustrating so far, because obviously I had to put companies and recruiters interested in my profile on hold.
            By the way, just throwing it out there to anyone reading if it helps, Linkedin does miracles for job hunting. For me it's been an incredible tool that connected me with tons of companies, headhunters and recruiters, so if anyone here is wondering the best ways to find a job..well Linkedin is one for sure.

              As an L1, I am sure you have fair amount of experiene and professional. Totally agree, as a professional all I use is linkedin, your profile "headline and summary" is super important in how recruiters in USA work these days.

              If you are at a point where you putting people on hold, and applied in June. Truly I would start looking to expedite now, at around 3-4 months with a job offer your expedite should work pretty fast.
