  • RFE for different name on birth certificate

    Hi,

    I went to AOS(Adjustment of Status I-485) interview yesterday along with my husband who is primary applicant. Interview went well except Immigration Officer said that she will be issuing RFE for Birth Certificate which has Different name than other Documents.
    My parents gave me nick name when i was born and that is registered in my BC and this name was never used anywhere else starting from my elementary school. I had 2 affidavits from my mother and aunt explaining that it is customary procedure to name something when baby is born and later it was changed to my real name but they never updated my BC. IO was not convinced, She said she cannot consider affidavits and asked me to produce Non availability of Birth certificate(NABC) under my name along with my school leaving certificates and affidavits from parents again. She said i should be asking for court order which states your name change but instead i am going on different approach by asking NABC. She said she will send official RFE letter in 2-3 days.
    I am confused how to get NABC since I actually have a BC but with different first name. I cannot apply for name change now to correct my BC since I don't have any official document with that name other than my BC. Everything else on my BC matches except my first name(like parents name,DOB,Place of Birth)
    I am planning to hire attorney to help me with this case. But any inputs from your past experience will be very helpful.

        I would try if it possible to request name change document from your original country or birth certificate correction, or come to your local court and ask if it possible to change your name by court order here in US.

        All my US documents not include full name from my birth certificate, but my Immigration Officer when i was filing N-400 insist on including unused part of my name from my Birth Certificate as middle name on my naturalization certificate. I refused and then he offered to file request to change my name, and when i was Naturalized judge approve my "change of name request" same time as naturalization.

        You case a bit different, but still try to call or better go in person to your local court and ask if it possible.
