  • I-864 question!

    Hello,
I just had a quick question regarding the I-864. I am a US citizen, petitioning for my husband (DACA recipient). I filed taxes for 2015-2017, and for 2015 and 2016, I met the minimum requirements. However, during 2017, I started graduate school and took a few months off of work. As a result, my 2017 income tax doesn't meet the minimum requirements. I will meet them for this year, but will that even matter? Will my 2017 tax return only be used to determine eligibility, or will I be able to somehow prove that I will meet the minimum requirements for this year? Will we need to get a joint sponsor?

I wanted to include my husband's income as he meets the requirement by himself, but we started living together in July and haven't met the 6 month limit.
    Concurrent Filing of I-130, I-485, I-765
Filed from LA, CA; adjusting from B-2
    Married to USC, DACA recipient

    Income

You can put your expected annual gross income for this year. Make sure to include your paystubs with your current rate. It would be better to get a certificate of employment that says your job title, expected annual gross income and current rate.

This information is in the instructions on how to fill up the i-864 if you want to verify it.

Are you self-employed? Or do you have a job with a salary?

This is my personal opinion and is not to be construed as legal advice.
