I485 Married to US Citizen

  • I485 Married to US Citizen

    Hello All,

    I need some suggestions on my case , I am Married to a US citizen but my marriage happened in india and i came back to the USA on F1 student visa. But my issue is we didnt get the marriage registered in india as a result we dont have a marriage certificate .

    I have now filled i485 i130 i765 i131 but submitted all the photographs of the marriage and also hsubmitted a affidavit from my uncle that he has visited india for our marriage cermony .

    Will that be enough or will my petition will be cancelled because of not having a marriage certificate ?

    Please advise.

    It says on the USCIS site under checklist- "If your marriage certificate is unavailable or does not exist, submit other acceptable evidence such as church records and proof of unavailability or nonexistence." In my opinion, you should try to get some additional evidence to prove the marriage now in case you receive a Request for Evidence.

      I do not know how it works in India, but in the US you have to register your marriage to be legally married.

        In order for a marriage to be recognized for US immigration purposes, it must be conducted according to the local law of the country where it occurred. If you are saying that you held a ceremony but didn't get legally married, then it won't be recognized for US immigration.

          Why just not get married again in US?!
          There is no crime to get married again to the same person in different countries.

          I know cases where to married again much easier than get all additional papers to get married certificate recognized by local authorities. Couple got religious ceremony and register the marriage in native country of one spouse and then register a married again in country of another spouse.

          Religious ceremony back in India would be a good evidence of bona fide marriage.
          Plus nobody would question US issued marriage certificate.
