  • Need help! Can I stay in USA to wait for the interview if my F1 status get dropped

    Hi everyone,

    I have a situation that I applied for adjustment of status 485 almost 2 months ago (07/08). And I was still an F1 student back then. But my F1 might get dropped due to some issue at school. Can I still staying in the States to wait for my interview or do I have to leave immediately?
    Also, if I can stay without F1 status, does my husband still able to add me to his car and health insurance? Is my driver license still valid or I can drive at all?
    Thank you so much for helping me. I dont know much about this and i dont know where to find these answer.
    Field Office at San Bernadino

    PD at August 2nd
    Biometric appointment at August 28th
    Finger print review completed at August 29th
    Form I-485 is ready to schedule for interview at September 4th
    EAD card on hand at January 10th
    Interview was scheduled at Feb 4th 2019

    Did you receive the NOAs from USCIS? If yes, you are in pending status so you're good. You can't leave the country until you receive the AP. However, I, too, have been advised to maintain my F-1 status despite the AoS pending status because if for some reason your petition/application is denied, you will be out of status and probably ordered removal. As for the DL, it should still be valid during this time.

    11/15 - New card is being produced (I-765)
    11/26 - EAD combo & SS card
    01/13/2020 - Interview
    01/23/2020 - Case Approved, Card Mailed.

      Yes. I got all 4 receipts. I want to keep my F1 status too, but I am about to graduate after one more semester and my school wont let me delay it like add extra classes or so. And my advisor told me that since I applied for Adjustment of Status, I no longer can apply for OPT or so.
