  • AOS to Consular Processing?

Previously filed for AOS last July in Dallas, still waiting to hear anything about an interview date but online it says ready to schedule for interview since March 2018. Need to go back to my home country for 10 months, so assuming I would have to withdraw I-485.

Should I withdraw and reapply through consular processing while I?m back in my home country, or hope my AOS won?t get an interview for another 10 months and try to get an AP and go back that way? If interview gets scheduled, would I be able to push the interview date? Also not sure if I withdraw, would they count this whole time I?ve been in AOS status as overstay.

Does anyone know if it?s possible to transfer I-130 from AOS to consular processing? Or would we have to refile?

I would just travel and use your Advance Parole to re-enter the US.

Travel abroad before AP / Combo card approved

Hi all ! Anyone experienced if we travel abroad before AP approved, then it?s approved during you abroad and your family mails it to you to re-enter US. Is that ok ? Please advise. Your response on the matter is highly appreciated. Thanks

No, if you leave the US while AOS is pending before AP is approved, and you don't have H or L status, you automatically abandon your AOS.

This is my personal opinion and is not to be construed as legal advice.
