  • After Interview - Case Held for Review - Timeline?

    Hi everybody -

We had our interview yesterday and it went pretty smoothly. The whole thing took about 20 minutes, not a lot of questions asked, and the conversation was casual and pleasant. We answered all of them and had all the documents IO asked for. At the end he said he does not have authority to give out decision and his supervisor would need to review, so he gave us a letter saying the case is held for review and no further information needed from us.

Our lawyer told us this is standard process now and not every IO has the authority to give out approval on the spot.

I'm wondering if others have run into this before, and if so, how long did you wait for an update?

    Thank you!!

I had an interview in June and then about 3-4 weeks later, they reached back to me for another interview which took place in August. 2 weeks after that they mailed me RFE and 1 week after they received my response, the card was approved.

So, in your case, if everything went smoothly, I'd say 2-4 weeks.
    Good luck

Thank you for your reply! Was there any sign in the first interview that prompt you to think that there would be a second one? Was that a surprise to you?
And if you don't mind me asking, what was the RFE related to? You don't have to share if it is personal.

      Thank you!

          Interview - Chicago

Hi there. My spouse and I had our interview on September 10, 2018 at Chicago Field Office. If I remember it right, the name of the officer who interviewed us is Cody. Few questions asked too. The next day, they approved our case and card in production.

We had similar experience at our AOS interview @ Norfolk field office in VA. Interview was short and sweet. But IO gave us a printout saying needs further review and as she needs time to go through docs we submitted. Said upto 4 months for the decision.

Hopefully we will both get ours way sooner than 4 months!

Congratulations on getting through the interview! I urge you to look at the positive side of your experience. Had the officer had any pressing concerns about your case, you would have gotten a RFE or a NOID. And you did not get either. I recall that you front-loaded your evidence with as many documents as possible with your AOS package. I do not anticipate any issues for you.

The officer who interviewed you was likely new or in training. Many offices have increased staffing levels to keep up with the additional interviews for employment based and k-1 AOS that are now required. So he/she just has to have all his/her decisions vetted by the supervisor.

I say - let the cake bake in the oven.

                  My case held to

Hi all I would like to share my recent experience at my interview for the adjust of status.
the interview was on the Newark field Office on 10/02/2018. Our appointment was for 8:55 at 14th floor.
Well we get there like at 8:15am and seat at the waiting room for maybe 40 to 50 minutes then a officer call us by our names and took us to his office, he was a little serious man.
Ok when we get to his office we make the oath and then we seat.
He first started asking for our I?d (license) then he ask for my passport I?m the beneficiary my wife is the petitioner, the he ask for my wife passport. Then he ask for my medicals exam because I do not submit those with the application because some times it gets expired for the long processing times At USCIS, then some random question of How we met, when we get married, where we get married, how many people assist to the wedding, date of birth and others that I can?t remember but very typical questions.
then he ask proof of the relationship we have, we gave him the most recent taxes filled together, join bank statements, join car insurance, join credit card statements and the pictures we have together. Then he make the yes/no questions at the form I-485 and that?s it.
but at the end he told us that he would recommend us for approval but because my wife became US citizen right after we send the petition( we first send the form I-130 because she was waiting for her us citizenship interview when she became US citizen we send the rest of the forms I-485,I-765,I-864) he have to wait for that file to complete the information he has 😩😩 we where a little disappointed he say that it could take maybe 1 day maybe a week maybe few months then he give us a Notice of Interview Result. Saying that my case is held for review 😩😩.
and that it?s now i have to wait. Did anybody knows about a similar case??

I would reach out to your Senator and ask them to request your I-130 file to be sent to the field office. It's re-election time. They will be more than happy to help you with your request. Start the letter with "To The Honorable Senator Jane Smith" and close it with "Very respectfully"
                    Find your Senator here https://www.senate.gov/general/conta...nators_cfm.cfm
Fill out the Privacy Release Form and call the office to ask how to proceed. Some offices won't accept emailed privacy release forms, some prefer faxes, some prefer emails. So just call and follow their directions. You are calling to request assistance with USCIS - to have your I-130 petition sent to the field office.

                        Nvc

Thanks I just call to the NVC to see if they have my file but they tell me that they already send my form I-130 on August 10 just 4 days my interview was scheduled. Now I?m confused because I thought that the officer doesn?t have that file but it looks that they already have it. Sow now I don?t know what he wants to means when he tell me that because my wife became citizen few months later after we married that he needs to recive a files to complete the case . What files he could be talking about??
