  • I-485, Application to register permanent residence or adjust status

    I-485, Application to register permanent residence or adjust status: Application filed and was received on the 7th of September, had already received receipts for the petitions. Biometric completed on 3rd of October but mail was already sent on 28th of September for request of initial evidence(I-485). I received it on the 4th of October and they requested for the petitioner/sponsor on form I-864, affidavit of support, must submit a complete Federal income tax return submitted to the IRS for the most recent tax year. We used a reasonable sponsor because my wife who is a U.S citizen filed her tax in 2017, 2016 was with her ex then 2015 under her mom, that was why we sorted to be sponsored even though we still added her 2017 tax documents.

    I have two questions, first, should we still repackage her 2017 tax returns back to USCIS even though it was submitted with the application previously, second, my wife did her pregnancy ultra sound test on 4th of October and it was good, should I include the results when I would be mailing requested documents to USCIS? please any helpful contributions would be appreciated, we were given 87 days to submit the documents, thanks all!

    What you previously submitted was the copy of your petitioner/sponsor's complete 2017 federal income tax return; this time though, for the RFE, USCIS would want to see the 2017 IRS Return Transcript. The Transcript is generated by the IRS, validating that they have received your petitioner/sponsor's 2017 tax return. Tax returns can be forged or tampered with, so for validation purposes, USCIS would want to see the one coming from IRS - which is the transcript. You can request for your petitioner/sponsor's return transcript here: https://www.irs.gov/individuals/get-transcript. You have 3 ways to get it for free - download it online, have it mailed (arriving in 5-10 calendar days), or thru fax. Best to try all options, whichever comes first, wins lol. Does the RFE mention anything about the income? For good measure, along with the IRS transcript, submit your petitioner/sponsor's 2017 W-2, 6 months pay stubs, and latest 12 months bank statements. Make a cover letter explaining what your response is all about, accompany it with a table of contents stating what each document is for. Make sure to put the copy of the USCIS RFE letter on top of the cover letter; USCIS will scan that letter first.

    If you feel that you didn't submit enough Evidence of Bona Fide Marriage in your original I-130 submission, then this is your chance to make your I-130 petition stronger. You can include the ultra-sound test along with other new evidences, e.g., updates on your lease/telephone/electricity or other utility payments, insurances, joint bank accounts, etc. But if you feel you've front-loaded enough evidence the 1st time and you have no new evidences to show, then you can forego the test for now, and just include it in your interview kit.

      I would ask the Doctor to give you a letter stated that you wife is pregnant, it could be even started "to USCIS" instead of "to whom it may concern" (it is more clear for an IO to understand that your wife is pregnant from the letter)

      I've sent such a letter with scanned pictures of ultrasound, appointment date cards and parking tickets paid by my husband when filed. On the day of our interview, the birth certificate of our baby was asked first, it was clear the officer looked through sent documents before our interview.

I tracked and saw it that as at 9th of October, I have been scheduled for interview and they would schedule and mail me cause my biometric was done on the 3rd of October. I really wanna know if am on the right track or if that is how it's being processed, I'm absolutely new to this, I would please be glad if I am advised if that was the procedure. Moroever, I have not done medicals and they have not told me to do so.

            "They said" - is it on your case status online or you gave them a call?
            Have your interview been scheduled or it is ready to be scheduled?
            In general looks like USCIS accepted you affidavit of support and related documents.

            DO YOUR MEDICAL now, or as soon as you receive I-797C for you interview appointment.

              Adjustment of Status ( I-485)

              I tracked my form I-485 today and this is what I found: On Oct. 31st, 2018, we scheduled an interview for your form I-485, application to register permanent residence or adjust status, receipt number....... we will mail you an interview notice. Please follow...... That was the status I found when I tracked today. I would like to please say that I have not been notified with form I-693 to do medicals, does it mean USCIS will be sending notification for the I-693 while I await notice of my scheduled interview? Please I would be glad if I could please be advised on what to do in that regards. Moreover, how could I locate applicants who filed from Cincinnati Ohio or Ohio

                You can go ahead with the medical... When you're done with the medicals you'd be given a sealed envelope, take the envelope with you on the interview cos they'd request for it or tell you to do it and and send after the interview... It's your choice though.

                  Thanks for the update, please how would I know the medical test I need to do, should I just download the I-693 form and take to the Surgeon?, thanks

                    WOW, your interview is scheduled already - that was FAST!! Congratulations! If I remember correctly, from your initial post on the forum, you said you submitted your AOS packet Sept 2018, then you had an RFE, too. I think, yours will be the shortest AOS journey I've seen in the forum lol!

                    So, what you need to do now is prepare for the interview. The actual interview notice will probably arrive by mail this week; expect the interview to happen 1 month from now. I would like to reiterate that you sign up for USPS Informed Delivery - very important. Have you?

                    Two things to prepare for now are: I-693 medical report and evidence of bona fide marriage.

                    First, go to the USCIS website and search for your nearest/cheapest USCIS-accredited civil surgeon: https://my.uscis.gov/findadoctor. Ask around for the cost of the exam, they're a bit pricey. Call the office and tell them you'd like to schedule a medical exam for your immigration application with USCIS.

                    Then, go to USCIS website, download their Form I-693 for the Medical Exam: https://www.uscis.gov/i-693. Read the instructions carefully. Fill up only your information, not the Civil Surgeon's part in the form. DO NOT SIGN the form yet. You will bring the form to your medical exam appointment, and sign the form in the presence of the civil surgeon. If you've done vaccinations in your home country and you have the records with you, I suggest you bring that to your medical exam, show/tell the doctor what vaccinations you've undergone. If you don't remember or don't have records, that's fine. Just go have the medical exam done by the USCIS doctor. On my part, I was vaccinated 3x: MMR (Measles, Mumps & Rubella), Varicella (Chickenpox), and TDAP (Tet****, Diphtheria and Pertussis), then, blood was drawn for my blood test. It will take a few days for the blood results from the lab. Just a heads-up: The medical bill for the administration of the vaccines might be separate from the lab test. Best to check with the clinic if you will be getting 2 separate bills from them.

                    After you're done with your vaccinations and blood, the doctor will fill-up and/or sign the form and will ask you to also sign it. (Some doctors forget/fail to sign the form unknown to the applicant, so on the day of the interview, when the IO checks the I-693 and there's no signature, they'll send an RFE after the interview, thus, holding up the GC approval. So make sure your doctor signs the form.) After the clinic has all the medical results in, they will mail you the I-693 report - sealed and signed on the flap. Do not open the envelope. Bring the sealed I-693 report to the interview; the IO will ask for that.
