  • Green card in Hand but i-130 status online is still in review

    Hi everyone,

I would like to thank everyone for all the help received so far in this journey.

We had our interview and it went very well. Officer said that the case needs approval from a supervisor and we should hear back within 30 days. Two hours after the interview, I485 online status changed to card in production and the i130 states that the case is held for review. I did receive my receive the GC 6-7 days after the interview. I am assuming that the i130 was approved as well since it is the basis of approval on the i485.

Does it matter that the online status for the i130 did not change to say approved?

    Congratulations!
You have nothing to worry about. Several people have reported that their status never updates. You can't approve a I-485 without approving a I-130. Both petitions must be approved for a green card to be granted. You have your green card in hand. You're all set.

The online status for my I-130 never updated from the initial status even several months after I had received my physical green card.

You should however receive three physical items in the mail from USCIS when your case is approved.

      I-130 approval letter
      I-485 approval letter
      Physical green card.

Here is my timeline info regarding the interview etc...

      6/7/17 - Interview
6/8/17 - Your green card was ordered text / email notification
      6/9/17 - I-485 approval text / email notification
6/12/17 - received physical I-130 approval letter in the mail
6/13/17 - Your green card was mailed text / email notification
6/15/17 - received physical I-1485 approval notice / welcome to America letter (I received a 10 year green card)
6/16/17 - physical green card was received in hand.

And like I said the status for the I-130 never changed from it's initial status, so that doesn't matter in the slightest. You should however receive a physical approval notice / letter for the I-130.

        Received the following letters

        Thank you for the reply.

        I received the following letters:

I-485 approval letter - Addressed to me (beneficiary)

I am glad that the journey is over with and I wish you all the best in this process. I will no longer worry about the case status update.

Congratulations! Make sure that your "resident since" date is correct. USCIS has issued green cards with the wrong resident since date. If you've been married for less than 2 years, then it should be a conditional card. Sometimes they will issue the 10 year card by mistake. That can cause problems down the road. Inspect your card.

If you were approved for conditional permanent resident status, you are now on the I-751 Removal of conditions wagon. Live life - but the journey is far from over. For removal of conditions they expect to see evidence since the date of the marriage until the time you file. Even if you'd already shown that evidence for AOS, it does not matter. The I-751 is usually adjudicated at a Service Center and not at a field office, unless USCIS feels an interview is necessary. To be clear, Service Centers will adjudicate your petition with the evidence you send them. See screenshot below.

Here is an example of the level of evidence and detail that USCIS expects. https://www.immihelp.com/forum/showt...346#post582346 This is the Table of Contents that we used as an example to submit our evidence of bona fide marriage for AOS.

            Thank you UScitizenFilingforspouse.

The resident date is correct and yes it is a conditional green card. We will continue to collect evidence that we will be used to remove the condition. Thank you for your advise on this and your feedback is very helpful.

            Cheers
