Need help- stressed and concerned

    A denied immigration application will follow you around forever. Its the first question they ask at the interview. What privilege? To get fringe benfits and false hope? To be on USCIS radar? To be deported and potentially banned? Favor really?

    People can choose to break the law if they want, people can rush into marriage if they want, the spouse can also go live in a sanctuary city and live underground. The spouse can work illgeally if they want. Asking someone to marry you so they can stay in the country with you for 1-2 months then decide whoops I am over it and send them home. Someone who has family in the USA and will for many years not be able to get a visitor visa due to this past application. Prolly will be very difficult to even get any sort of work visa.

    You need to stop thinking America is so awesome and that cause before people could overnight get the American dream. And then a path to citizenship. The guy in the whitehouse and many others around this country have made that heck harder. I doubt the spouse even has her EAD and is currently making money, even after the 6-8 months its taking she gets an EAD carrying on the sham is misrepresentation and could lead to a ban. This is where selfishness kicks in, any lawyer is going to advise OP to not let his spouse keep her EAD and withdraw the application asap once they explain what is actually at risk here.

    You are silly enough to think the tiny chance this lady has is going to end up a LPR living with her sister happily ever after. But ehh if all the hardship and future risks is worth that tiny chance to you to keep alive. Myself and few others commented its clear based on the OP posts he has made up his mind and just wants someone to let him know he has no risk in this situation. Then again maybe you right and it all ends happily ever after.

      I am not taking sides in this discussion and as you can see from my signature, I am an intended immigrant as well. I absolutely DISAGREE with your replies. You suggest committing fraud and call it ?a favor?. This is illegal. OP is not doing anyone any favors by knowingly commiting fraud, which could land OP in federal prison for 5 years and get a fine of $250k. I hope you realize how serious immigration fraud is, for your own good. If their marriage is broken, than so be it. OP does not ?owe? a Green Card to his wife nor is he obligated to commit fraud as a favor.

      I am bit disappointed and taken aback by seeing people here suggesting illegal stuff.

        So what I'm getting from this is you have no intention of continuing the marriage, y'all don't get along, and have no desire to be together but she wants money so you're sticking with her so she can continue to use her EAD to stockpile some cash before she leaves? yeah that is Absolutely 100% FRADULENT! literally what you are doing is just as bad as someone marrying someone to get their green card in trade for impregnating The USC.. Cali I disagree with you because there are some people who get married quickly and it's a true bonafide marriage. but this is FRAUD for sure! divorce her now, and get on with your life and let her live hers away from you.

          I would presume OP married in good faith.

          I chose not to reply to your other comments. I don?t have the energy and time is way too precious to waste my energy on someone else?s problem. Focus on your own process (note to self)

            Sorry friend, my responses getting confused you answered it much better. No problem with short marriages, mine is way short and we passed the interview. Problem with people who think they should be allowed instant divorces and after they move out right away and as you mentioned using ?fringe benefits of EAD? to avoid paying their responsibility. Again you said much better and more direct.

            WaitedLongEnough, you are a very nice person I bet. But OP repeatedly mentioned while at the time of marriage maybe it ws bonafided and made sense, shortly after they moved out and wanted to seperate and divorce. Must be in a bonafide marriage with evidence during while green card process till approved after interview.
