No Update after AOS interview

Hi All,

First of all thank you so much for the help these forums have provided, i am grateful to each and everyone of you.

My Timeline is as follows:

07/10/2018 PD
08/01/2018 Bio metrics done
09/19/2018 Interview completed.

I know by some miracle my case took 2 months from filing to interview. My interview was at Buffalo NY office, then entire interview must have lasted about 20 mins. The immigration officer just asked us to confirm our details on the form, and after that he just asked us one question about how we met, which my wife answered. That was the end of our interview, he did not ask for any additional proof ( we had a whole folder filled with supporting docs). After interview he said he doesn't think ours is a sham marriage and we should hear from them in couple of weeks. It has been 4 weeks since our interview and nothing has changed on the website. I called USCIS but no update. Can anyone suggest what i should do next or had a similar experience.

Any help would be greatly appreciated. All the best to everyone

I received my update 5 weeks after the interview. Luckily, the officer had told us to allow two to five weeks. I'm afraid that at this time all you can do is wait and pray. at the end of my interview I was given an interview approval letter by the officer. Did you receive any type of results letter at the end of the interview?

That's a really fast timeline! Congrats! I would say that it might be a good time to reach out to your Senator and have them inquire on your behalf. You will have to fill out a Privacy release form. You can find that on your Senator's website. You will explain your situation. Be specific and concise. Start with "To the Honorable Senator Joe Smith" and close it with "Very respectfully"

I also know of someone whose case was held for review. They were newly weds and had not presented much evidence of bona fide marriage but the marriage certificate when they filed. Then for the interview, they still did not have much. So he followed the tips found on this thread https://www.immihelp.com/forum/showt...794#post583794
and got very creative with gathering evidence, he brought it to an Infopass appointment and the officer accepted it. Shortly after, his EAD/AP combo card was approved. Maybe you can drop off your evidence at Infopass?

Thank you so much. This is what is making me nervous the officer did not gave us any letter. I have heard people usually get an approval letter or a letter stating that their case is held for review.

They will say "we do not need any additional evidence at this time". BUT what that really means is that they will make a decision based on the evidence they have in front of them. If you feel that you have concrete compelling evidence that would help them make a favorable decision, then insist. They will have you sign a form that states you are submitting additional evidence.

Do not be afraid to ask specific questions like:

- did they run additional background checks? Have those cleared? (If they have not cleared, there is nothing anyone can do. Those run on their own time)
- When should we expect a decision?
- are we being considered for a 2nd interview?

Thank you. it is strange that Buffalo NY does not schedule Infopass appointment. what should i do, just go to the office irrespective?

The Buffalo Field Office Infopass page states they do not accept walk-ins. If you need a passport stamp or have a true emergency, then call USCIS contact center to make an appointment.

It sounds like you submitted plenty of evidence with your initial filing. If that's the case, that would explain why the officer did not ask for more. I would probably still have your SENATOR inquire.

Based on your timeline, my best educated non-legal guess is that your background checks are not finished yet. Those can't be rushed.
What you can do to move on with your life right now, is call to expedite the EAD/AP. Tell them that you already had your interview, and that the USCIS Policy manual states that interim benefits are to be approved if your case is not adjudicated right at the interview. You should get 2 referral IDs since you are requesting EAD/AP. Then with those two referral IDs you can go to your Senator for them to inquire on your behalf.

Bear in mind, your case just moved really fast - way too fast. Now everything else has to catch up.
