  • I-485 Adjustment of Status - Awaiting decision due to new visa quota

    Hello All,

I have been reading many threads on this forum and appreciate everyone's posts. But I haven't come across this exact situation that we have so I am posting this thread here.

Our I-485 was filed under EB-3 category (employment based, not marriage based), and we attended our interview with IO on Sep 26th. At end of interview, the IO informed us that 'review of our case is complete and our file will be sent to issue greencards. However, they have run out of quota for yr 2017-18 and our file will be in pending list awaiting new quota for 2018-19'.

The new quota starts on Oct 1st, 2018, so it should be released already. But there is no status update on USCIS website after release of new quota. Is there anyone here who had similar situation this year or in the past and approximately how long did it take for you to receive the greencards or any other update from USCIS?

Thank you in advance for sharing your feedback!

You could reach out to your Senator, and have their team shake the tree. You can find your senator here https://www.senate.gov/senators/contact
Even if your senators are republican, choose one that is pro-legal immigration. It's election time. They will help you.

On their page, click on "help with a federal agency", follow the prompts. There will be a privacy release form to fill out. You will get a chance to briefly explain your situation. I would mention your pedigree - education, EB-3 - they like all that. Start the letter with "To the Honorable Senator John Smith" and close it with "Very respectfullly"
