I-131 Travel Document

Hello guys!

My dad passed away in my home country and I need to go home soon to support my family.

I have my EAD and my I-485 is ready to be scheduled for an interview.

How long does take to receive the travel document? And when I fill it, should I apply for re-entry permit or advance parrol? Also, is it guaranteed that they gonna allow me to enter the country again?

I'm so sorry for your loss, HSH. I wish you and your family all the best in this time.

For us, the AP was approved in about a month while we were in the Ready To Be Interviewed stage, but we never received it because our interview was scheduled, I guess. So it can be quick, but it can also take several months. You can probably apply to expedite it though, for family emergency. If you do, I would suggest doing so immediately. You would apply for Advance Parole, not re-entry.

It is not guaranteed that they allow you to enter. They usually do, but they don't have to.

You would just go to the Field office, turn in a I-131 application + a fee of $575. You have already had your biometrics done so they would approve it right there and then. You would walk out of the field office with a travel document.

To answer your question, reentering the US is not an issue. Your background checks cleared. We know that because your EAD was approved. You?re not on some watch list or aren?t a threat to national security. So they would just move you to a room for additional screening and that?s it.

When you applied for an EAD you did not also apply for an Advance Parole?

My recent experience

My dad passed away this September and I had to expedite my case (I have a pending i485 and had a pending i765&i131). USCIS gives precedence to such emergencies. After I tried to expedite my case, I got an RFIE on my i485. They did approve my expedite as soon as they received my evidence for the
RFIE .

It should be noted that I contacted the White House, congressmen,ombudsman and senators. I submitted my father?s death certificate and my birth certificate. Also, field offices grant emergency travel parole . They failed to give me one because I presented my airline ticket which had a December traveling date . They stated that they only grant travel docs if travel is within the next 24 hours. I think going there without my ticket would have been a better idea . Well I have my ead and my travel document now so 🤷🏿*♂️

The emergency advance parole is different than the one you already filled out. This one is a one time Advance parole. You get it the same day at the Field office. Sometimes the officer may make a phone call and have someone expedite it at the NBC, but that would take a few days. The Emergency advance parole on the other hand is granted the same day. Up to you.
