  • Traveling within 100 mile border while awaiting decision

Hi, I'm asking this on behalf of myself and my spouse.

We're in the middle of an Adjustment of Status, awaiting for the decision. We had our interview over 1.5 years ago and still waiting.

We live in NYC and have always gone traveling northward to upstate New York and into Vermont and other parts of New England.
But now we're scared to travel anymore due to hearing about the checkpoints that had popped in upstate NY and elsewhere in New England.

Are we being too paranoid? I figured we'd be fine if we carried with us the MSC # for our case. Can't think of anything else in that regard which we could take with us which might make a difference.

His Visa, Birth Ctf and our Marriage Ctf may or may not make a difference.

Please, give us some useful advice. Thank you.

Did you just say you had your interview 1.5 years ago and youre still waiting?
Have you done anything to check on it? That?s pretty long. I would ask them, ask a senator or congressman to check on it.
    1.5years is not common.

Anyway, I?m currently in NYC now for a mini vacation. Few days ago, we went to Upstate NY, around Lake placid
and have not encountered or seen any CBP officers. I brought photocopies of my receipts, and also brought my red card with me just in case. I felt safe and comfortable the entire time. You should be fine. Goodluck!

      Re: BayArea response

Yeah BayArea, more like 1 year & 9 months now. May I ask, What do you mean by red card?

Also, we're afraid to badger anyone since this is our second go around (already had a previous interview through which we were denied); and well, our lawyer's proving herself to be borderline worthless with the way she confuses us with other clients when we call her.

do you have EAD and Advanced Parole by any chance? AP allows you to travel.
Even though you are in the US so it shouldnt really matter. Just bring your papers.
Stop acting paranoid folks, unless you got something to hide there's nothing to worry about.
This is my opinion, not legal advice!

          Is he out of status?

My husband and I recently traveled within 100 miles of the border (CA) and brought copies of his Receipt Notices, his passport w/visa, and his EAD. Earlier we did NY & NE. We did not encounter any CBP officers anywhere.

          For your reference:

            I meant EAD/AP card.

Thanks for the replies, but we honestly don't believe that to be a prudent move.
Not all cases are similar and ours is extraordinarily complicated. So much so that it's dependent, as well, upon the responses from his native country as well as a judge in Buffalo amongst others.
It's likely that part of our case is sitting within a pile on someone's desk at one of these locales.
Having someone stepping in onto someone's toes would be a very very bad idea.
              Thanks all the same.

                Traveling by plane?

Sorry to bother, but my question is almost alike. Just wanted to ask if we (who adjusts status) allowed to travel by plane (within the USA of course)?

In my situation, I overstayed B2 visa for 3 months and at the moment I am waiting for a combo card. Can I only travel by car until combo card issued? Or even with combo card I better stay away from airports?

                Thank you!

You can definitely travel with your valid passport.
                  They don?t check anything else.
They just want to make sure your id matches your plane ticket.
Recently went to NY and I used my foreign passport with no problems at all.

                    Thank you for the answer!
I've read several stories about that - sometimes in some locations they do check immigration status and might deport you (I read especially in Florida), but the receipt letter from uscis can protect us from deportation.
