  • Interview process and confused about the IO's last words (marriage AOS)

    Hi guys,
    I just went to the interview today 8am. We called in at 8:30-8:40. My husband is USC. I am F1 OPT.
    IO was nice and polite but also alert.

    First he asked us to sworn and sit down
    Then he asked us if we have new joint documents and new photos. And asked us to show him original marriage certificate and birth certificate.

    Then he said he will ask us lots of questions. Remind us: do not try to answer for each other.

    Some questions I can remember:

    1: BASIC INFO
    -how did you meet?
    -how did you decide to married?
    -what's your husband degree?
    -what's your husband high school? (strange question)
    -Company information
    -Job description
    -How did my mother in law become American citizen? (through the family; my husband was through his parents)
    -Ask me the home address, my SSN
    -Ask my husband my birthday
    -Ask me My husband mother's name?
    -What's her job? When did you first meet his mother?
    -Ask if we meet each other's parents: his father passed away.
    -Ask where is his father grave? (not sure about the question, he explained)
    -Further asked about the location of the grave (I said the location but not sure because I haven't been there)

    2. ABOUT WEDDING

    - Saw the photo and asked Who is the marriage officer? Did you meet her before? (ordered the service on line, just email each other, because we are not belong to any church)
    - Ask my husband was my mother attend the wedding (yes)
    -Where did we buy the wedding band? (New York)
    -Which store? (we don't remember because we just shop around that area...several gold stores in that area)


    3. Details about our dating history

    -When we first meet, where did I live?
    -Did I have roommates?
    -Ask my husband if he could speak my language? (Yes)
    -Ask me his favorite Hocky player? I said "Crosby"
    -Ask my husband is that correct?
    -Ask what other sports does my husband watch?
    -Review photos and ask some random question... like what car does you husband drive? How many time have you been to Florida?
    -Ask my husband about one of our friends who wrote the sworn letter for us. WHo is that?How did she know your wife?
    -Any situation my husband traveled alone without me.
    -Ask if we want to have children? (I answered honestly: not now, we want to save money because kids are expensive; well I know people say we should express
    the eager to have a child. But I cannot lie. )
    -Ask my husband how many kids do I want? (He said We haven't decided which is the truth)

    4. 485 questions:

    -J1 visa? (I used it before) Purpose of wavier? (Employment)
    -All the "no" questions on 485 (took about 20 mins on it)

    He asked me to sign on my 485; he explained every notes he made. There is a notes of receipt number for my J1 wavier on the j1 question .
    He said they often review the application after the interview. The notes are for the other officer to review.
    I asked if he want the I693( didn't submitted it but seemed he forgot?). He said" yes please"

    After all of this, he talked about something about Deny and NOID: I was almost faint. (!!!!!)"......If you get denied. you can reopen it in a amount of time";
    Then he said "I don't think that's the case for you but just want to let you know"; Oh my ... I felt better. But why he explained it to me???????????

    He then said "if we need further documents from you, we will mail you in 1-2 weeks. Currently I don't see I need anything further."

    "Because you guys' marriage is less than 2 years, the green card will be conditional. Did you look through the remove condition process?" I said yes...
    "First you will get the welcome letter and then you will receive the green card in mail. IF you didn't receive the GC card in xx weeks you should call us"
    "Again if we need anything more we will mail you. "

    "Another usual problem is with the eligibility on 485. But you have waived your J1; I don't see you have that any problem with eligibility" (so am I ok?)

    "For today, I can approve the I 130" (confused? what does that mean?)

    "Do you have other questions?" (we said no...he explained the possible results about 15 mins. I should've asked if we get approved or not. But I was hesitated and afraid he would not give us the answer)

    He then saw us out but didn't shake hands . He has medical rubber gloves on his hands. He smiled and said" Have a good day".

    He didn't give us "120 days hold for review" notice or anything....no "approval on spot" just said 130 is approved.

    I am still confused.

    So is that normal that IO will explain the Deny NOID thing to you after interview? I thought he was going to deny us when he started talked about that.
    My husband said it might be standard procedure to explain everything beforehand.

    Forgot to mention: when we walked out of the building it's 9:15. So the whole process was about 40 mins!

      Congratulations on this milestone! I think it went well. It sounds like you had already submitted plenty of evidence with your initial AOS package. The rubber gloves tell me the officer is maybe new and not used to dealing with papercuts. Total speculation on my part, but I flip through sheets of paper every day and know to keep heavy duty moisturizer handy. BUT I could be wrong.

      I'd just wait out the 2 weeks. He said to call them if you do not hear from them. I would just make an Infopass appointment now, because they're scheduled two weeks in advance. That way you can inquire in person. As you may know, when you call USCIS, you are calling the contact center. There is no way for them to transfer you to the field office.

      Hang in there. NOIDs sound scary but often times, officers choose them over RFEs when they want to address your response in 30 days instead of 90 days. Do not stress out. I would just wait, and continue to live life. Focus on your loved ones. That's in your control.

        Thank you! I guess he's new too. He looks like 30 something.
        Maybe he has a supervisor to review the documents so he cannot say yes or no. Just explain everything to us.
        I think people usually get a notes "120 days to review..." but we didn't get anything.

          I think people usually get a notes "120 days to review..." but we didn't get anything.
          Most field offices have hired new staff. Maybe he was being extra thorough. They're actually supposed to explain how to remove conditions. But it just sounds like he was extra thorough. Believe me, had there been any reason to declare you inadmissible, you would have likely known right away. It's hard but try to continue to live life. Just thank God/Jesus/the higher being you believe in for granting your green card in harmony with everyone. Do not ask. Give thanks for it's been granted already. And then let the cake bake. Don't open the oven door until it's baked.
