  • I have a job offer but no biometrics yet

    My timeline is in the signature. I applied for one job being 90% sure I won?t get it. Surprisingly, I got called in for an interview with the managers and stakeholders and today I got a call with an offer! They offered a salary over my asking and explained that it?s contingent on a background check and drug test. I consented to the background check and now I?m waiting for the drug test scheduling. Needless to say, I really want this job as it would boost my resume by 1000x and also keep me busy. I still go to school full time in accordance with my F-1 status. I?m not going to slack on school.

    The start date is November 12, so I have one month to get my EAD. Is that reasonable? I?m still waiting for my bio appointment and once I get the letter I?ll go for a walk-in ASAP. If I understand it correctly, once the walk in is done and the review complete, my status should say ?Fingerprint review completed?. After that, I should place a request with USCIS and also with my Senator/Congressman. I have proof of job offer and also several bills in my name alone that can prove I need the income.

    Does this sound right? Is it doable in one month?

    Congrats on your job offer. Kind of on the same boat, and will try to expedite. Not sure how it works if the BIO has not been completed yet, im sure others can give you a better answer, but I think you qualify to expedite.

      Thanks for the congrats, same to you. I know it's not possible to expedite before the BIO, which is why I am waiting for the letter. I hope I'll receive the bio appointment this week, since it's been 3 weeks since my PD. After the bio appointment, I'll send the expedite request.

        Congratulations on your job offer! Way to go! I think a month is enough time. I would start by calling USCIS to get your biometrics appointment letter. I would insist on speaking to a level 2. Be ready to provide a fax number. They may be able to fax it to you. I don;t know if you are able to place the request to expedite before you even get the biometrics letter. Ask the level 2 what you should do.
        Right away, I would get the ball rolling with your Senator. They can shake the tree. The biometrics letter should not be taking this long. Yet, it is. Tell the Senator's staff that your goal is to expedite your EAD/AP. You want both, even though you will only provide evidence for the EAD.

          Thanks for the reply! I called USCIS today but the waiting time was 25-40 minutes! I?ll try again tomorrow. So can I just contact my Senator even though I don?t have the bio letter yet? That?s great.

            Yup, maybe the Senator can make that biometrics letter fall off the tree already.

                Senators have more clout. I would read through their page first and make sure you are reaching out to someone who is pro-legal immigration.

                  I?m in WA, so it?s as liberal as it gets. Both the Senator and the Congressman have pro immigration agendas and web pages dedicated to Assistance with fed agencies. Is it possible to contact both of them or it?s pointless?

                    The privacy release form usually asks if you have contacted another Senator/Congressperson and when. I would start with one Senator, and go from there. It's totally doable. Call the office to make sure you follow their directions and there are no delays. Be very polite. Do not use any inflammatory language on the letter. Sometimes they just forward to USCIS whatever you send to them. They're not supposed to do that BUT it's happened. So it's better to err on the side of caution.

                      Thanks for the advice. I didn?t plan on bashing USCIS, haha. I?m not upset with them, I know they?re doing their best with what they have and the resources are limited.

                      The Senator?s office asks for the privacy release form and the supporting documents via email. I prepared a typed letter addressed to the Senator with very official and respectful language giving some details about myself (current status, school, degree, etc) and the fact that my husband is a registered voter, blah blah. I explained why I need the EAD asap due to the job offer and why this job is important for my career. I estimated the monthly bills I have in my name and attached 3 of them to the letter as proof (car lease, electricity, internet).
