  • I-485 got denied due to missed an interview

Hi, on Oct 24th, I received an email from USCIS that they denied my I485 (my case is family base, I married to my US Citizen husband). On Oct 26th, I received a notice letter they denied because I was missed an interview request me to appear at the Houston Field Office on Oct 22nd.

However, the problem is I have never received any interview letter from my Field Office at all.
They give me an option to file a motion to reopen or reconsider. That would costs me around $700 and I don't want to pay for something not my fault.

We informed USCIS to change to the new address since we moved and also I received an email about address change confirmation.

Luckily, I was able to make an infopass appointment on Monday, Oct 29th to talk with IO and hopefully they can reopen my case and reschedule another interview.

So I am wondering what should I bring to show to IO that I already informed USCIS change to my new address? What should I say to convince him reopen my case without filling motion to reopen form?

Any help would be greatly appreciated.

I am sorry this happened to you. It's fixable, though. Do you have an account on these two sites?

I would definitely sign up for accounts on those two sites. The officers at Infopass are actual Immigration Services Officers. The reps you talk to on the phone are not. So you want to be very polite and respectful, and ask what can be done. Mention that this seems to be USCIS error. You're hoping the officer can help you get your interview rescheduled. See what they say. Take notes. Make sure you understand the steps they tell you to follow.

Even if you do not like the answer, do no use any inflammatory language. After the Infopass appointment, you should contact your Senator's office, and ask them for assistance. You have two senators in Texas. They are both republican. And that is fine. They can still help you. I would probably go with Ted Cruz. https://www.senate.gov/general/conta...m.cfm?State=TX

There should be a privacy release form on the website for you to fill out. Without that, they cannot assist you.

      All the best,

      USCFFS

PS: Please report back on this thread how it all goes. It will help others in a similar situation.
