  • Joint sponsor RFE checklist

    The RFE for my I-485 will be delivered tomorrow but I am trying to get everything ready before that so when the letter comes, I can mail the response back ASAP. My husband (petitioner) is self-employed, so despite us attaching plenty of financial docs, including official IRS transcripts, I am almost positive that the RFE is for the I-864. So I decided to have my uncle, who is a US citizen, be my joint sponsor just to be sure. I wanted you guys to advise on what documents to tell him to prepare and send over to me. He lives close by so I will have the form signed and everything tonight.

    About him (joint sponsor): W2 employee and 1099 for the past 10 years (same employers), no dependents, not married, income well over the 125% guideline, never sponsored another applicant.

    This is what I think should be included:
    - Form I-864
    - Copy of his US passport
    - IRS transcripts for the last tax year and the previous 2 years (optional)
    - Pay stubs (last 3 months?)
    - Form 1099 for the last year (is that the correct document?)

    Thanks for any input!

    INITIAL AOS from F-1, married to USC, filed in Seattle WA

    09/24/2018 - Package delivered to PO Box (PD)
    10/22 - Early bio walk-in
    11/15 - New card is being produced (I-765)
    11/26 - EAD combo & SS card
    01/13/2020 - Interview
    01/23/2020 - Case Approved, Card Mailed.

    If your spouse made enough money to sponsor you, why you need your uncle ?a sponsor ?

      My 2 cents even though I know I was over cautious and still haven't heard from USCIS so who knows...:

      - I believe 1099 is only for self-employed people and W2 is for employees.
      - We put my husband's pay stubs for the last 6 months + employer letter.
      - IRS transcripts for the last 3 years and we also added the W2 for 2017 (even though this is not necessary when you can provide transcripts).

      * 11/06/18 - 4 NoAs in mailbox
      * 11/10/18 - Biometrics notification in the mail
      * 11/21/18 - Biometrics Appointment
      * 12/05/18 - "Fingerprint Review was Completed" i-485 and i-765
      * 02/27/19 - "Case is ready to be scheduled for an interview" i-485
      * 02/28/19 - Received the i-693 Courtesy Letter
      * 05/20/19 - 2 NoAs for i-765 and i-131 in mailbox
      * 05/22/19 - Combo Card in hand

        Because, for some reason, USCIS is stingy about self-employed people. Especially because my husband was W2 until January 2018 and switched to 1099. I don't know, but I assume they think it is not as reliable as W2.

              You need employment letter of your co-sponsor, very simple letter include his name, current working .., address, and his boss signature.good luck
