  • Questions for Rescheduling AOS Interview: help pls.

I am a silent reader/user of this website. But my silence can no longer save me cause I really need your opinions on a couple of stuff

    Interview Date: today: Oct. 31, 2018 (15 months -_-)
The problem, however, is that my husband (army) has a BLC training this date and would not be able to attend the interview.
Oct. 18, 2018, I was able to grab hold of an infopass and talk to the supervisor and he told me it's up to me to attend the interview alone but because we are living separately he says that it will cast a doubt on the bonafide of our marriage (the reason though, as to why we are separated is because I was able to grab hold of a job in a good company in salt lake (the place where i stayed when he got deployed abroad) and it was so difficult to find a job in black river (the place where we stayed when he came home, and where he still currently is now). We, however, were both planning to settle in Hawaii next year (March 2019). In fact I have the DA form 5888 (command sponsorship) that listed me to come with him as he gets deployed in Hawaii (final orders were not yet made).

Our lawyer (yes, we hired one: because we are honestly both bollocks with rules, paperworks, and stuff) said they will be the ones to file the rescheduling and gave me a letter that states the reason as to why we needed to reschedule the interview. I haven't received any notice yet coming from the USCIS about the new schedule or the like. I asked the paralegal about the things to bring on the initial interview and she said to just bring the letter that they gave to me.

My question now is, should I follow what the paralegal said and just bring the letter for reschedule on the interview? Or is it still necessary to bring the documents stated in the interview notice for the (like the proofs and other stuffs) for initial interview?

BAD IDEA to reschedule an interview with USCIS. If you?re claiming that your husband is deployed , that is one of the most ligitamate reasons for him to not be present at your interview. Also, you have to front load tons of PROOF that you?re working in ?X city because of X reason. Tons of PROOF. Your husband should have provided you with PROOF that he is deployed. I am amazed that your attorney didn?t advice you if this unless there?s something missing to the puzzle. Who to tell that he also won?t be deployed for your future interview? All the best !

So is your plan to attend the first interview with a letter asking to reschedule? If I were you I'd attend the first interview and bring EVERYTHING, including all the evidence to support your situation. I recently saw another post in this forum from someone who attended the interview alone because their husband is deployed. I think everyone understands the scheduling difficulties that come with being in the army- so I would not worry about that "casting a doubt." Although your situation may be different than most, it seems like you have good reasoning for all of your actions. Just bring enough evidence to support it. If USCIS decides they want you to come in for a second interview with your husband I would let that be their decision. Just my opinion. Good luck!

I'm jumping in to ask about something related:

My husband and I are getting married a second time in July 2019 with our friends and family in my home country. It will be quite a big party and we will be out of the country for 2-3 weeks to celebrate. Maybe I am optimistic thinking that our interview could be as soon as July 2019, but I was wondering if that could be a legitimate reason to postpone our interview. I mean, it's OK for us to cancel a vacation or even reschedule our honeymoon, but our big wedding, it would be tough...

        Thanks for your opinions!

          I know it hard decision!
But I hardly recommend to NOT DO IT!

Too many things could go wrong: USCIS could mess up and have 'No show up for interview", rescheduling could take months even years, officer already get you file ready for interview and later misplace your file, or get suspicious/annoyed that you ask for reschedule...
There are many successful reschedulings, but you don't wanna be the one.

You would know ahead at list a month ahead about interview, you will have time to arrange everything around THE date.

          Good luck!
Hope the interview date will not interfere with your Big Day!

I don?t believe this is even a question right now. Please cancel your plans to have this big wedding. We are gaving a big wedding 2020 and getting pregnant same year. You can consider 2020 , that?s a significant year

Ok guys thanks for your feedback!

Ah well our wedding is happening for sure as we?ve been planning for a while now! Ugh now let?s hope that, applying from NYC, our interview is not going to break a world record for 2019 by being planned 8 months after filing (I?m probably the only one hoping for that!) - I?ll keep you guys posted.

We are having our wedding reception on January 2019 in my home country. Hopefully we'll get our interview by December 2018 but chances are it may be scheduled on January 2019 as well. There's no way we'd cancel the wedding. Worst case scenario, we'll just reschedule. I honestly care more about the wedding than the green card lol Hopefully we'll have the interview before our trip
We asked at an InfoPass appointment and were told it shouldn't be a problem at all.

Ha thanks! Haha, I feel you and same - I'd have to reschedule the interview. We are getting married in France and many people are coming from the West Coast, many already booked their tickets, hotels, vacation, etc. In the meantime I also read about people rescheduling for less than that (just traveling home) and it wasn't an issue. For sure, you never know and there's always a risk the file gets lost or anything, but hopefully, everything goes smoothly.

First of all, thank you for your husband's service. Second of all, you should go through the military helpline for all matters related to your case. https://www.uscis.gov/military/military-help-line Third, it is not necessary for your husband to attend the interview. USCIS gives you the option to attend the interview by yourself. Remember that a lot of Immigration Services Officers are former military/law enforcement agents. They understand.

Now if you REALLY want to attend with your husband, I would either request for the interview to be scheduled before he is deployed OR after he returns. I know of a military wife who requested just that. She reached out to her Senator in Minnesota. Told them her request and that she wanted to attend the interview with her husband. Just like **** *, her interview was scheduled before he was deployed. That was less than 6 months after filing. Mind you, the Minneapolis Field office is one of the slowest in the country. So it's a pretty big deal.

I'd say... give that a shot. But again, USCIS has no issue with you attending on your own. Now, if your Senator is sympathetic to your request, awesome. Just know that they do not have to be, because it is not necessary for your husband to attend.

                    All the best,

                    USCFFS

If you're filing from NY, July is only 8 months....the wait for an interview is between 12 and 24 months. If you are granted AP, it should not be an issue, but i doubt you'd be interviewed by then

It's all entirely up to you. The wedding is not a humanitarian reason or emergency. SOOOOO if you request to postpone your interview, there is no guarantee that USCIS would schedule you for the next available slot. You've probably noticed that USCIS takes actions on cases in waves. They schedule interviews in waves, they approve combo cards in waves or cycles - you could say. So when you start requesting X Y or Z, you inevitable take your little raft out of the path of the wave.

Here is something else to think about. I was told by a very reliable source who learned this from an Immigration Services officer at Infopass. Being selected for interview is pretty much random. Yes, they select cases from the "Case is ready to be scheduled for an interview" pool. The system does not necessarily prompt the officer to check the priority dates to make sure that person is next in line. Remember that the previous processing times were given as a date. "As of May 31st, 2018 the Minneapolis field office is processing cases filed on or before 12-01-2016". Officers don't have that date anymore. That date does not exist. Think about. So of course, now if they grab a case filed on 08-01-18, officers no longer have that 12-01-2016 Priority date as a reference point. So it's a gamble.
