  • Marriage based GC, ability to move jobs??

    Hi all,

Filing in NYC from an E3 based in marriage to a USC, and just got updated to ready for scheduling interview. Currently working but not the biggest fan of the company and would love to seek other employment. However as my application has my current job, is there anything that I can do to move a new job without impacting the application?

Also will I get a separate EAD as part of the process, that nullifies the Visa before the GC arrives?

    Thanks all.

There's a certain amount of confusion in your question. First of all, your visa is about entering the country, so nothing you're doing nullifies the visa. Second, I'm not too familiar with the conditions placed on employment for E-3 visa holders, so I presume you're currently not free to change employers. Third, did you file for I-765 (Employment Authorization) with your AOC file? If yes, you will receive a new EAD card, with which you can indeed work for whoever will employ you in the US. If no, you won't. Once you get the green card of course you are completely free to change employers.

My suggestion: If you've neglected to file I-765, do so now. Initial filing. It's free with an open I-485 application. But it'll take 4 months or so before you get your new EAD card.
