  • Girlfriend is here on a B1/B2 visa but needs to get a divorce first, please help!

    Hi Everyone,

So I met a girl and we instantly fell in love. The problem is, she is still officially married but they have had a lot of problems so they no longer live together but now the husband wants to get a divorce now that her and I have started a relationship.

I have a few questions, so she already applied for the adjustment of status but if she was to get a divorce now, would she be able to still stay in the USA and finish the petition? If not, would she be able to remarry immediately to me and then we start the process over again? I know that may cause the government to think there is fraud but is it at all possible?

Beyond that, is there any other way for her to stay in the country, any other visa or any way for her to self petition?

    Thank you!

I don?t mean to butt into your personal life but why are you dating a woman who is married ? Secondly, did she get married for adjustment of status or is she in a bonafide marriage because no person who values their marriage allows things to crumble that easily ? Thirdly , how do you know this woman isn?t just a con artist and just wants to get a green card by any means necessary? Listen man , it is your life but be smart and don?t think she won?t cheat on you just like she did to her now husband.
