About to file, a few questions...marriage based, mainly i-864

  • About to file, a few questions...marriage based, mainly i-864

    Hi,

    UK Citizen married to USC. We are about to self file our paperwork - i-130, i-485, i-131, i-765

    I have a few questions;

    We are using a joint sponsor, do we have do provide annual incomes for all three tax years or just the most recent?

    Then as far as i understand you submit either an IRS transcript or a 1040ez with w2s and 1099s ?

    As we have a joint sponsor, i understand my husband (USC) still has to complete a i-864 too, so i just send 2 x i-864 within my paperwork ?

    We have only been married 2 weeks, and im not able to work in the USA so don't have that much evidence for bon-fide marriage; we have a joint lease on an apartment together, have been together 4 years long distance, lots of photos, engagement and marriage cards from family, and sworn affidavits from family members, our parents were at our wedding and witnessed on the marriage license, confirmation of trips (flight and hotel bookings) to visit each other -- we don't have any joint accounts or financial documents. my husband is supporting us both financially.

    any help is appreciated

    From the questionst that you are asking, I am gathering that you have not read the instructions to most forms. Please slow down and read the directions first before attempting to fill out and send your AOS package.

    Submitting the 3 most recent income taxes is optional. Only the most recent year is required. That's on the instructions.

    Page 8/17 also states "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income"

    Since that paragraph was so poorly written, we sent transcripts along with W2s & 1099s.

    Many have found this thread useful in preparing their evidence of bona fide marriage for their initial AOS filing and the interview.

      Thank you for your help. I have read the instructions for the i-864 but they aren't very clear.

      on part 6 of the form, question 23b states it is optional, whereas 24a-c doesn't state if optional -- it is unclear to me whether i need to fill these boxes in?

      Lastly for both my husband and joint sponsor having to both a file a i-864 the instructions is unclear on how your differentiate between which is the i-864 you are using?

      i dont want these forms to be returned to me just because i missed out a box.

        Here is the link to the instructions. https://www.uscis.gov/sites/default/...i-864instr.pdf That's what I meant by instructions. It sounds like you are following the directions on the form. You have to actually read the separate set of instructions which state specific instructions for each set of questions.

          Yes, any person filling out an I-864 needs to fill out the number from the "total income" line of their tax returns from the last 3 years. You only need to attach one year's worth of tax returns, but that is a separate requirement from the need to provide the "total income" number from the last 3 years.

          You can start some joint accounts now. Add each other as beneficiaries on insurance, etc.
