How does Advance Parole work ? I went on USCIS site and it says it can be granted to only LPR who has lost their passport or green card ? Please help. Death happened today and really want to see if I can go home

You might have accidentally look at I-131A. It's I-131 that is the form to apply for Advance Parole (that form can also be used to apply for Re-entry Permit and Refugee Travel Document, but you are not applying for those). If it's an emergency, you might want to apply for Emergency AP in person at a local office.

This is my personal opinion and is not to be construed as legal advice.

I am very sorry for your loss. There are two ways of going about this. Option A. If you applied for the I-131 already with your initial AOS filing, then you could try calling to expedite it due to family emergency/death. Know that this option will still take a few days while the new card is being produced and all the motions that you have to go through.

Option B is requesting emergency advance parole. https://www.uscis.govhttps://www.imm...ergency-travel This option requires that fill out a I-131 form and bring with you the $575 filing fee to the Field Office. You will need an Infopass appointment. To secure one, you can try the website. Otherwise, you can call the main USCIS number. If a level 1 cannot help you, then seek a level 2. Who knows? They may be able to call the field office and make arrangements for you. I believe that you should be able to go to any Field Office or ASC or Satellite office for this service - double check! If you are willing to drive, then you can go to a farther location that has available appointments.

Alternatively, you can also ask your Senator for help. They should be able to contact the field office directly, as well.
You do have to bring proof of travel arrangements; i.e., flights.

This is not written anywhere but I have read of folks who show up to the Field Office with the form, filing fee and flights and tell the guard they're there to request emergency travel and they are eventually allowed in.

Hope it all works out for you,

There are several posts around the subject. In a nutshell, it's very straightforward. By now all airlines are familiar with the document. CBP also makes it straightforward.

              Did they approve it?

I have not read of anyone having an issue. But again... every case is different.

                    Infopass appointment made

                    UScitizenFilingforspouse ,
I felt comfortable with making the appointment so now I feel a little safer that they are expecting me and I am not just showing up , you know ?
My only concern now is how long does it really take for them to issue this ?emergency advance parole ? ?

Some more questions so that I am fully prepared.. the website says to bring the following:
A completed and signed Form I-131, Application for Travel Document
                    The correct I-131 filing fee
Evidence to support the emergency request (e.g. medical documentation, death certificate)
                    Two passport-style photos.

WHAT ELSE SHOULD I BRING THAT WOULD BE A GREAT FOR MY CASE ?
Please help if you have experience with this or if you have any knowledge 🙂

A lot of times, people miss their appointments or forget to cancel. It's not unimaginable that they would agree to see you without an infopass appointment- especially, if there's an emergency, like a death in your family.

You do not have to do much convincing, really. Often times they want to see evidence that you purchased your flights. From posts I've read, it takes a few hours for them to issue the document. You may have to wait a bit, but you will walk out of there with your Travel Document in-hand. This is separate from the I-131 you filed with your I-765.

Now that I do actually have an appointment I will walk in , before my appointment. I hope to gather necessary doc like something to show from hospital/ Morge since I heard the death certificate may not be issued until the autopsy of which they are taking forever to do (My home country is very slow).

QUESTION: I actually never applied for I131 (stupid me , right)? What?s the difference? Emergency / non emergency? What do you mean ?this is separate for what?s filed with I131?? Please explain 🙂

*Gotcha. You secured an appointment but will do a walk-in before the appointment.* That was not clear to me before.
This emergency advance parole is a one time deal - I think. You get it for the dates that you are traveling. That's why they want to see that you have plane tickets, etc. You could ask them if it could be a document that you can use for multiple entries. If they say no, don't push it. Just get what you can, and go see your family.

The "regular advance parole" is the one that most of us got with the combo card. It allows you to be paroled more than once.

                              I got it . Thanks !
