  • My case was rejected

    Here's a little background information before I jump into my most recent update.
    I filed back in july and my pd is 07/24.
    Later I received a letter for the biometrics that was done on 08/30.
    On 08/31 they said my biometrics were received and cleared.
    On 08/23 responded to a RFIE about the I-864 Affidavit of Support.
    According to the tracking number, it was delivered on 08/30, but I have never received a notification about it.
    0n 10/31 I received a refund check. On 11/01 late at night they updated it, saying it was a refund for the I-485, but it shouldn't affect my case.
    I called the USCIS about one or two weeks ago and asked if they received it, but the lady was not helpful.
    Yesterday my husband and I called again. We were told again that they didn't know why I got a refund, but the amount was exactly the same for the biometrics. We told them
    that I have done my biometrics. My husband asked to talk to another person, and the guy said that it was late, but he would have a person from the 3rd level call me today.
    Needless to say, no one called. For my disappointment, I checked my status again, and this time said that my case was rejected because they didn't receive a payment. The note says that they sent a letter o 07/24 about the payment problem, but the thing is I have NEVER received anything regarding payment. The NOA even states that I paid all the fees. We used money order. We went to the bank to ask them to track the checks. We found out that the USCIS only checked the $85 and $535 ones, and the $1140 was never checked. We don't know why, but that is so upsetting because I have waisted 4 months for nothing. I don't understand how they asked for more evidence when they knew the process wasn't going nowhere, instead of giving an update about the payment. I am so sad! The guy on the phone told us that there is one letter on its way to notify us about the rejection. He advised us to wait and see what it says, and then take the necessary action. The problem with these letters they send is that they are not clear. I got one about the fee refund, but it didn't say why or what they were refunding me for.

    01/14- Credit Card was charged
    01/14- text messages for I-485 and I-131
    01/22- Received form I-765 back. Got rejected due to incorrect fee??
    01/23-Submitted I-765 again.
    01/31- Early Biometrics appointment
    02/01- Fingerprint Review was completed
    07/30- case is ready to be scheduled for ...
    08/31-EAD in hands
    10/22- Interview (approved)

    Gather all your documents, all your emails and everything. When the rejection letter comes in , I suggest you follow the instructions and appeal. Write a detail well constructed and mannerable letter. This is not the end ! ALL THE BEST

        Reach out to your Senator, Congressperson and Ombudsman. Complain to the Office of the Inspector General with DHS. This is USCIS error and they must rectify it.

        That's my best non-legal 2 cent advice.

          You sent 3 checks ($85, $535, $1140)? The $85 and $1140 should have been in one check, totaling $1225. Checks broken down as:

          A) $535 (I-130 Petition form)

          B) $1225 (for $1140 I-485 AOS form fee PLUS $85 Biometrics fee)

          The lockbox staff probably got confused that they returned/refunded the $85, thinking it's an excess. But when it came to check your AOS form, the check was only for $1140, making it incorrect 'coz there's no biometrics fee, so they had to return that check, too. But they should've caught the discrepancy and returned your I-485 packet for payment correction early on...and not 4 months later. When you get your I-485 packet and check back, maybe you should use personal check or credit card next time. On the note portion of your $1225 check, write "Payment for AOS form fee $1140 and biometrics fee $85 for applicant [your name]".

          Hope you get your packet and check back soonest. Wish you a speedy process moving forward.

            what you said makes total sense. I think that is exactly what happened. We broke the fees down in 3 checks because we thought it would be
            better for them to understand what we were paying, and I guess it ended up messing everything up.

              it may be easier to understand that way.. But always ALWAYS submit it the way it says in the instructions. USCIS is notoriously picky about how things are submitted and will reject applications for stupid things like that. I heard ab out one case where they rejected an application because the check that was submitted had a check number that was an odd number instead of an even number. Now while I think that is probably not true. they do nit pick like crazy and will reject for stupid reasons which is why you should always follow the instructions to a T.
