  • I-765 Work Related Question.

    Hello Guys.

    F-1 student Married to USC.

    My PD was 08/10/2018. i am done with my Bio on Sep 10th, My I-765 status says Fingerprint review has been completed and I-485 says case is ready to be schedule for an interview since Oct 23rd.

    i am still pursuing my master in computer field as F-1 student and taking 3 course per semester. i confusion regarding my I-765.

    1st: Can i expedite my EAD with any job offer latter or it has to be related to my study(Computer field) to expedite my EAD card. (i can get Job offer later from my friend's Food Restaurant as Manager)

    2nd: Am i eligible to work out side of my field for now before my Interview or it is going to jeopardize my case because i am still F1 student before getting GC.

    I do not know if there is a rule but I just successfully expedited my EAD based on a job unrelated to my major. I mean, it is sort of in the same sphere but I do not think USCIS looked at my major and then compared it to the job description. Just my 2 cents.

    10/22 - Early bio walk-in
    11/15 - New card is being produced (I-765)
    11/26 - EAD combo & SS card
    01/13/2020 - Interview
    01/23/2020 - Case Approved, Card Mailed.

      Hi!

      I see in your signature (timeline) that you asked to expedite your EAD and about a month later you got a notification that the card is being produced.
      Any idea if the card is the "combo" card with the advance parole? or just the work permit?

        I have not received the card yet but I am pretty sure it is the combo because both the I-765 and the I-131 statuses updated to Case Was Approved.

          Have you ever seen the card alone (Not the combo)? I haven't. My friend actually expedited i-131 for funeral back home and received the combo anyway.

            Thank you for the information. well my fingerprint review has been done by Sep 10th and its been more than 2 months now, no update on my EAD card yet.

            i will try to give call tomorrow to USCIS and asked for the level 2 officer to communicate with and let see what he/she says.

              There is a good chance that your interview will happen before your combo card is adjudicated. I would ask the Level 2 for the physical location of your file. Ask if it has been transferred to the field office.

              I am saying this because the Norfolk, VA field office has been a relatively fast office - historically. The processing times that I see posted seem generic. If you click on other field offices, you will see that many other offices have the same processing times. Therefore, they're not exact. They may not report processing times and USCIS just slaps the generic ones on there.

              Finally, the NBC sets aside applications for I-765/I-131 that are in fast jurisdictions. And that makes sense. Why work on those if you won't have to wait too long for your interview.

                  You're welcome! Glad to be of assistance. Make sure that you speak with a Level 2 rep. If they tell you that your file is still at the NBC, ask if you are on the list for interviews yet. And when does the L2 estimate that the file will be transferred.

                  Start preparing your evidence of bona fide marriage; especially if you didn't submit much with your AOS filing. Many have found this thread very useful.

                    I have just called USCIS and talked to Level2 Officer. she said my file has been put into the Queue for the interview but file is still into NBC center. she said it will take approx 120 days for your filed office to make decision on I-485 for interview, and for I-765 she said NBC center is working on July month's files so Probably they will start working on August file maybe next month.

                      Good! That all makes sense. It sounds like the L2 was well informed. I would apply for jobs, and place a request to expedite once you have a job offer. Things may slow down a bit during the holidays. Adjudicators have a lot of time off.
