  • Date for filing and filing of I-485

    I am seeing a light and guessing it is the end of tunnel

    The Date for Filing has reached and my attorney has started preparing documentation to file I-485, I have the following questions, if you can help answer:

    1. Is there a timeline within which I-485 should be filled from the date of Date for Filing?

    2. If I-485 is filled based on Date for filing will I get EAD within 3 to 4 months time irrespective of whether Priority Date moves or not?

    3. After filing of I-485 based on Date of Filing, will I get Receipt within 3 to 4 weeks from USCIS or 3 to 4 weeks after the Priority Date is reached?

    1. You can file I-485 during any month where the USCIS chart for that month says your category and priority date can file. It is not always "Date for Filing"; sometimes it is "Final Action Date". Whatever date it shows in USCIS's chart, is that date that applies for AOS for that month. Just because your priority date can file one month does not mean it can file the next month. So if you wait so long that it becomes the next month, then you have to look at that month's chart; and there's a chance that you will no longer be able to file in that month.

    2. It's more like 5-6 months, but yes.
