  • Case must be reviewed (extended review)(question about EAD renewal)

    Hi everyone

My PD is March 2017 had my interview on August 2018 they approved I130 and they said my I485 need review.

now its been around 3 months and a half since the interview, I talked to one of the senator office a few weeks ago then I got a mail from the senator office saying my case remains under extended review and there unable to move forward this time.

is there anyone have a similar case?
MY case now on hold for more than 20months

also, I sent my EAD renewal and they received it on may but I didn't hear anything and its out of processing time that's why I submitted a request for expediting the EAD and I sent the evidence last week when should I receive reply from them

what is the best action now?

You may ask the Senator's staff if they know the reason for the extended review and the nature of the extended review and if they may tell you the reason. Sometimes USCIS reveals the reason to the Senator's staff, but tells them to not divulge that information to you. You may ask if they are running additional background checks. You may ask if you are expecting a second interview or a home visit. The I-797 for your renewal and your Expired EAD are proof of an automatic 180 day extension on your EAD.

so my Automatic 180 days will expire Janurary 7th that's why I have December and the first week of January if I considered holidays I have less than a month and I didn't get anything. I already sent an expedite request evidence last week. when should I receive a response.

so based on what they said in the info pass just a day before I talk with the Senate office is that background check.
the complete reply was noted to me from the Senate office is that

"According to U.S. citizenship and immigration(USCIS) records, Mr.ZZZ case remain under extended review. we are unable to move forward with the application at this time. while the processing steps for most applications or petitions are completed quickly, a small percentage of cases involve unresolved issues that may result in adjudication delays.
USCIS is unable to render a decision until certain issues are resolved. USCIS is striving to resolve these issues as soon as possible. We are unable to determine at this time when the review process will be completed."

as I said they approved the I130 during the interview so I don't think they will make a home visit and even if that's fine. we have two kids and no issued between me and my wife.

You have the right to interim benefits (I-765/I-131). Just ask your Senator to help you expedite the EAD while you wait for USCIS to adjudicate your I-485.

Please start a new thread and list the details of your case. This will be better for tracking updates and replies to your question.
