  • I131 after concurrently filing I130, I485 and I785

How likely is it to receive our I131 since we didn't initially file for it with our paperwork. I wasn't as informed as I am now back then and the person filing the paperwork was against it because of the way things are going with the people in office.

My original PD is March 12, 2018. I was given a PD of October 3rd for the AP. We're NYC filers and it looks like we'll be waiting a long time before an appointment (at which time we'd be eligible for a 10yr gc)
    3/21/18 - file (I-765, I-485, I-130) received by NBC
    4/2/18 - Received 3 receipts for 3 cases
    4/2/18 - Received biometrics appointment
    4/27/18 - biometrics complete
7/6/18 - I-485 Ready to be scheduled for interview
    8/10/18 - EAD in Production
    8/13/18 - "We approved your case" I765
8/16/18 - We mailed your card to you

You can get an emergency AP , if you must travel back to your home country, for example, ASAP. You will just have to prove the emergency. You should also be able to get a non emergency AP as you?re qualifyied by having a pending I485.

Since you?ve already applied, If you need to expedite AP put in to expedite if you have an emergency.

All the best and glad seeing you around after a minute (maybe you were just silently reading ) hahaha

I filed form I131 after concurrently filling I130/I485. All you require is the I797C stating you are in the AOS process and you should have no problem. I didn't actually recieve the AP document as my GC was granted- something to bear in mind with long wait times. The NBC is currently showing a processing time between 4 and 6 months.

I would reach out to your Senator and ask them to help you expedite the I-131. Tell them your I-765 was already approved. Since your background checks are finished, USCIS should be able to just approve it.
