  • I-131 Advance Parole question

    Hello all,

    I have just submitted my AOS application on Nov 27, 2018. We didn't send an I-131 application as we don't have travel plans at the moment. I understand that you need to send proof of future travel. Can we still send an I-131 application later on if we decide to leave the country?

    Another question, can I apply for a state ID without SS? I live in LA.

    Applicant: B1/B2 Visa holder
    Filing from Los Angeles
    10/20/2018 - Chicago Wedding (same sex couple)
    11/27/2018 - Sent to Chicago Lockbox
    11/29/2018 - PD I-130
    12/03/2018 - Bio fee accepted
    12/07/2018 - NOA received for I-130 & I-765
    12/20/2018 - NOA received for I-485
    12/24/2018 - Biometrics appointment received
    12/26/2018 - Biometrics taken

    You do not need to send proof of future travel to submit your I-131 application when you file concurrently as the spouse of a US citizen - category c9. At this point, you may send it once you receive your I-797 notice of action for your I-485.

    Regarding state ID's or Driver's license, just consult your DMV's website.

      You do not need to provide any reason or purpose to apply for an AP as an AOS applicant. Both I-765 for EAD and I-131 for AP are free for AOS applicants, so there is no reason to not apply for them. You can file it later as soon as you get your I-485 receipt.

          It takes 3-6 months to approve, so apply now as soon as you get your I-485 receipt.
