  • New public charge rule + Income requirements.

    Hi all,

    Are you guys apprehensive about the fact that the government will likely increase the minimum required income for a US Citizen to be a sponsor of a marriage-based Green Card?

    My fiancee approx 250% of the poverty line, which is exactly where the government will set the minimum at.

    I am applying for AOS in January/19, should I be concerned? Can I use my parents in a different country as sponsors?

    I think your sponsors must be in the US.

      I would recommend reading the I-864 instructions. The instructions are a separate document. It's 42 pages, I think.

        I don't see anything in the proposed rule that would require anyone to have 250% of the poverty level.

          If and that's a Big If they were to increase those requirements, it would have to go through a ton of yellow and red tape before it was approved just like every law. so unless it's already been sent to the supreme court for final judgement and approval then you should be fine.
