  • New Card is being produced but can I fly outside US on AP/EAD

    Hi,

    My GC interview went well and she approved the case right away.
    Same day I got notification of 'My new card is being processed'
    The company I work for is asking me to visit Europe on business trip & I agreed.
    But when I called my lawyer, she said it may be still risky to enter US if your GC is still under process.
    Did anyone had same issues?
    I heard you can travel on Advance Parole document.
    Plus all my interviews, paperwork or biometrics and case has been approved to t he final stage.

    My GC is being processed was changed on 12/04 (on Tuesday) field office was in Lawrence, MA.
    Let me know if anyone had same experience?

    I would personally be very cautious. If I remember correctly once your case has been adjudicated, EAD/AP documents become invalid so you wouldn't have the appropriate documentation when trying to re-enter. Make and infopass appointment and try and get the I551 stamp.

      I read somewhere that they do not do I551 Stamp anymore.
      I already said no to my company when they asked me 8 months back for travel.
      Now the situation is such, they asked me again...
      It's like risking job..
      Are you sure my EAD/AP are not valid any longer after my I-485 card is being produced?

        Can't you wait a week or so? Our status changed on 11/26 to card being produced. 11/30 card was mailed and 12/6 card was received. 11 days from interview to card in hand
        11/20/17 - PD - Marriage Based AOS
        12/10/17 - Walk in Biometrics
        4/10/18 - EAD & AP Approved
        4/18/18 - Interview ready to be scheduled
        4/19/18 - Combo Card in hand
        10/22/18 - Interview has been scheduled
        11/26/18 - Interview Completed
        12/6/18 - GC in hand

          USCIS is required to provide the stamp even if you have an NTA after your I-751 is denied. What you read is not entirely accurate. I would make an Infopass appointment and request the stamp if this is a true emergency OR wait for the card to arrive in the mail.

            I can only wait for a week...
            Issue is my manager has already asked me before, I said I cannot. Now if I say same, it won't be good. Plus they clearly asked me at the time of hiring if I can travel to Europe.

            My travel date is 12/16/2018
            The status got changed from 'New card is being produced' to 'My case was approved'
            for both I-485 & I-130
            Not sure if this would take more time since there is nothing about the card.

              First, congratulations to getting your GC.

              I think you are safe to get it before 12/16 since the case is approved and the card is in production. Once they sent it, it should be 2 days shipping. There are 6 business days before your traveling.

              I will also try to see if your field office can pencile you under emergency travel situation. Try to give them a call and explain your situation.

              Worse case, if you don't get it before leaving, is it possible to have your spouse mail it to you to Europe? I think it will cost $200+, but if nothing works out, that $200 will worth it.

              Once everything is settled, could you please post your interview experience? If you posted it already, please share the link to me. I am in Providence, RI. It will be interesting to know your experience in MA.

                Yes, there is nothing else I could do except wait or gamble.

                Anyway, as for my experience...I do not remember exact dates but only months

                C(9) Adjustment of status from F1 (same like yours)
                03/30- They received my full package for (EAD, AP & GC)
                04/09- Got notification they received my finger print fee
                05/08- I guess I gave my fingerprints
                05/08- Fingerprints were reviewed & completed
                08/03- EAD card is being produced
                08/05 or next week- Got EAD/AP combo card in hand
                08/07- Notification update 'Ready to schedule an Interview'
                09/.. - Interview date and location received
                12/04- Interview completed
                12/04- GC approved by officer after interview
                12/04- Update notification 'New Card is being produced'
                12/07- Update notification 'I-485 case was approved'
                Now the wait if forever......

                  Is it truly imperative to your job that you travel exactly on the date they requested? You cannot ask to travel to Europe one week later and explain that your green card is in the mail? I personally would not risk it, but everyone is different.

                  Hopefully you will have it in hand by the time you leave. If not, trying to get an emergency 551 stamp is a good idea.

                  8/09: Advance Parole approved
                  8/29: Scheduled for Interview
                  10/11: Interview
                  10/12: RFE on I-130 (misplaced G28)
                  10/16: Sent new G28
                  10/19: Approved!

                    Got my GC yesterday.
                    So I think now I'm good to go?
                    I'll still carry my passport, EAd/AP & GC just in case.
