    Hi all,

    I have been reading through the forum and topics on marriage GC and have few questions.
    First IÂ’m sorry if this was answered in other topics.

    IÂ’m on B2 visa and have been in and out of US for last 2 years. I never overstayed and maximum stay was cca 4 months.
    My wife and I have met 2017 in June ( 6th to be precise ) in my home country. We keept intouch for few months and then on October I cam to se her here in US. I stayed for 4 months and then went back home. She at the same time traveled outside US, and we meet eachother in Asia for 3 weeks.
    Afther that she went back to US and I went again home for month and flew again to US to see her. This was April.
    After again 4-5 months of us being together in US on a daily basis we went for a trip to Europe and stayed 2 months there traveling around. She met my parents and grandparents and all of my close frieds.
    We flew back to US on October. We were living together ever since and got married on my birthday on this December.

    Now the questions is :

    a. Do we file concurrently all the forms or first I-130 for her and me and I-765 for work permit abd then I-485 and the rest?

    b. Will we have a trouble explaining why we got engaged in Europe and I still came on B2 visa ( even they didnÂ’t ask me anything at entry

    c. The priority of ours is my working permit so will concurrent filings slow my temporary working permit.

    A. You can file all of the forms together in one package. I-130, I-485, I-765, and I-131. You can’t file EAD (employment authorization document) and AP (advanced parole) without the I-485. I highly stress the AP (I-131) because it seems like you travel a lot. Once you file for adjustment, you CANNOT leave the US, until you have a valid AP in hand (or green card) or you will abandon your adjustment, EAD, and AP applications and the $1225 you paid to file them. You may also have trouble entering again on your B visa as you’ve shown intent to immigrate.

    B. If they ask, you’ll need to explain how you didn’t plan on getting married when you entered but changed your mind.

    C. You cannot apply for the EAD without the I-130 & I-485. It can take about 4-6 months. Concurrently filing is your quickest option.

      I just wanted to clarify that AP = Advance Parole. That's the I-131 application.

          You may post anywhere you wish. This is an open forum!

          I meant to tell you that #14 contains nice examples of the cover letters that you use to file each form. Use them as a guide. That way you won’t miss anything.
