  • Marriage based visa question - Spouse derivative green card

    hi,

I am a new member to this forum. I got my EB1B-Researcher green card approved (i485) on Dec 15th. I saw online notification. I gotten married to my spouse around 15th Nov and submitted her green card application as a derivative application on Dec 1. Mine i140 was already approved in Sep. She is yet to receive her tracking number. What will happen to her green card application now?

She possesses Indian citizenship. So do I.

You mean she filed I-485? I am not sure what you mean by "what will happen". Her I-485 is still pending and will be processed. A derivative beneficiary can immigrate at any time after you become a permanent resident, as long as you are still a permanent resident and a visa number is available for your category and priority date.

This is my personal opinion and is not to be construed as legal advice.
