  • Help! We live in the same state but don't live together everyday

    Dear All,

Today I got an update that our case has been scheduled for an interview and we're just waiting for the mail with the interview schedule.

Our problem is, my husband is in the Navy based in San Diego and I am in Los Angeles (2-3 hours away). He is currently staying with our friend and goes home to me in LA every weekend where his parents are also living in the nearby city. We don't live together everyday but of course we have documentations such as insurances, car, bank accounts, and a lot of pictures showing that we share our lives together (vacations, pics with family and friends, holidays, etc).

We decided with this setup because he plans to retire after 2 more years and go back to Los Angeles where his family and friends are in also. And me, my family is in Los Angeles as well.

Do we have a chance to pass the interview? Is not living together really a red flag? My lawyer said it's advisable to move in together but we can't just cancel our plans, or me to quit my job, and leave the apartment where we have a good deal. Has anyone been in a similar situation?

    Thank you!!

Well, he seem to be serving the country & as long as it is genuine marriage you should not worry.
Maybe explain why he is staying away cus of daily travel time etc & maybe his duties require him to report on call basis etc...
anyway if you have means consult an immigration lawyer.

How about adding evidence of the weekly commute? Toll and gas bills?
He is driving to be with you every weekend, sounds like a committed husband to me.

I am actually considering this as well. Except I will be in NYC and my wife will be in San Diego. If I fly back and forth between NYC and San Diego all the time. I wonder if that's OK because we don't live together every single day.
