  • AoS Interview in San Jose, California - EB2 India

    Employment Greencard, EB2 India

    Timelines:
    July 20, 2018 - Filed I-765, I-131, I-485
    Aug 8, 2018 - Biometrics was done
Nov 2018 - EAD and AP was approved
    Dec 2018 - Interview

My wife and I had our I-485 AoS interview in San Jose, California. The interview went fine. The application is held for review. No decision was made during the interview.

The interview was 1-hour long. There was only one officer interviewing both of us. We started with the oath and then he started reviewing our travel history.

He also immediately asked me to pull out ALL the documents listed in the interview notice, specifically, our tax records, auto, home, and health insurance documents, pay statements, credit card statements, marriage certificate and birth certificate.

My attorney had advised that that supplement J would be sufficient and the officer would not ask for pay statements. I provided him with my employment letter. I also let him know that I did not have the tax records or insurance documents with me. I had gas & electricity bills, marriage certificate and bank letter to prove that my wife and I were together.

He then made us sign waivers as there was no attorney present.

The interview went fine. He asked us about our recent trip to Europe, about the weather there, what I do for work, whether my wife works at a company and almost all yes/no questions from the I-485.

In the end, he said he would like to see my pay statements for last 2 months and tax records for the last 1-2 years. Plus, he said auto, health and home insurance documents along with our marriage photos would be very helpful to show that we were together (this was a nice to have request).

We drove back home, I got the documents he requested and dropped them off at the reception as per his instruction. I also included a copy of the AP and EAD cards for my wife and I, even though he did specifically request for them. His whole point was that we should provide him with everything on the interview notice.

No official RFE was issued. He said the files will be sent today (not sure where?!) and “they” will let us know if any other documents are needed.

Thanks for sharing what the officer asked. I will be up for employment based interview soon and this is helpful to know to bring tax records and pay statements!

One question, how did you manage to get interview so quickly? For India region the priority dates usually a long waiting time and if you only filed in 2018, does it mean you had your priority date set quite a while ago in a separate filing?

      My priority date

My EB2 priority date is Jan 2009! (Yes, 2009!)

I had applied for EB2 and EB3 concurrently. EB2 was rejected and then had to appeal. They never responded to the appeal (at least that's what my attorney shared).

Then we applied again under EB2 exceptional ability category. After 4 (yes, 4!) rounds of PERM rejections, I finally made it to I-140 approval.

It's not been an easy journey but I'm really excited about what the future holds.

Once my I-485 was submitted, things started to move fairly quickly.

        That makes sense them.
Congrats again, I know the India EB2/3 is a nightmare process.
Good for you that you stuck with it and made it through eventually.

Hello Kunal, glad that things are moving for you. I have priority date of Oct 07 (left US in 2009 and came back in 2017). Filed my I-485 in November after getting I-140 approved through PP in September. Already completed my biometrics and got the status updated with "finger print review complete and NBC is working on my I-485". When do you think I should expect an interview call?

          much thanks

I wouldn't be able to tell you when you can expect an interview call. If you haven't already, I would check the processing time on the USCIS website https://egov.uscis.gov/processing-times/.

              New Card Ordered

I received a text message and email stating "new card has been ordered". If all goes well, I should have the GC in 1-2 weeks.
