  • Company going for a Joint Venture process

    Hello everyone,

I'm an October 2018 employment based EB2 filer.
Recently my company has announced we will be part of a Joint Venture with another company where my company will be the minority shareholder.
This process will not take place until the second half of 2019 (likely September)
I have a few questions on how could this affect my application.

    - Will the JV enterprise be a considered a new employer?
    - If this enterprise affects my application, can I still do the 180 day portability rule since the new society will not happen until the second half of 2019?

    Thank you!
