  • Change H1B after filing marriage-based I-130?

    I am on H1B now but I am thinking switch job. We just filed I-130 concurrently with I-485, AP and EAD. But the wait here in NYC is very long.

    I know I can use the EAD but it seems unwise to give up my H1B in such an uncertain environment. Has anybody changed H1B employer after filing I-130?

    Or, is this even permissible?

    I'll definitely use my EAD and give up my H1B as soon as I get it and find a job I like. Not sure why you are so attached to your H1B? Do you fear having your Green Card application denied for some reason?

    * 12/05/18 - "Fingerprint Review was Completed" i-485 and i-765
    * 02/27/19 - "Case is ready to be scheduled for an interview" i-485
    * 02/28/19 - Received the i-693 Courtesy Letter
    * 05/20/19 - 2 NoAs for i-765 and i-131 in mailbox
    * 05/22/19 - Combo Card in hand

      I was advised not to give up my H1B even with my EAD. Because you never what changes will be rolled out tomorrow. Just want to play it safe in an uncertain environment.

        you do a valid concern and it is better to maintain your h1b status. Even re-entering the country on advance parole (even though you have a valid h1b) will lead to you abandoning your h1b - just something to keep in mind.

        To your main concern, I don't think it should impact your adjustment of status cause they are 2 separate things. The only thing that it might impact is your i864 in case you have used your income (along with the USC's income) and I do not know the ramifications to that - I guess it should be fine as long as it is above the minimum threshold.

        All of this is just my personal opinion.

        11/19/18 - Priority Date & Delivered to the Chicago lockbox
        11/26/18 - 4 texts received and checks cashed
        11/29/18 - Four I-797 NOA's in mail
        12/07/18 - Received Biometrics NOA in Mailbox
        12/18/18 - Biometrics Appt. Completed
        12/26/18 - Case Ready to Be Scheduled for an Interview
        01/07/19 - Interview was Scheduled
