  • Is Lease Agreement necessary?

    Hello everyone.

I have a question. Is joint Lease agreement necessary to prove cohabitation? Our interview is coming soon and IÂ’m worried without it it might create a problem. My husband moved in with me and my son. I didnÂ’t want to move to somwhereb else because of the area and my sonÂ’s school. We have been In the same apartment complex for 7 years now. The only issue is my husband does not have much of good credit and adding him would increase our deposit amount which we canÂ’t realky afford right now. Also the apartment is based on income for qualification so our combined income would be too high to stay in the apartment. The complex gets tax credit. We are planning on moving but not anytime soon. I have several evidence to prove cohabitation.

All of his mail comes to our address,
we have an apartment rental insurance policy in both of our names
We have a car insurance police in both of our names
He is on emergency contact list at my sonÂ’s school and I have a copy of it.
We have a joint bank account even though he doesnÂ’t often use it as he is not into banks. He prefers dealing with cash. And he normally just deposits cash into it. He is not that good with money so he leaves everything to me to take off as far as house bills are concerned.
We will open up a Sams club account in both of our names this weekend.
We will file joint tax returns for this year and claim my son.

Has anybody ever gone to the interview without a joint lease agreement?

Honestly, I don't have a joint lease with my husband as well since we live with his parents. I think you should be okay as long as you have other support, such as joint bank statements (with cash inflows and outflows every month), joint auto insurance, any 401(k) or retirement plans showing your spouse as the beneficiary, joint tax return etc. Having a joint lease is ideal but not detrimental. I wouldn't worry too much about it as long as the marriage is real.
