  • Interview

    I tried to post this yesterday, but it never appeared - so I'll try again.

    Hi,

    I'd be really grateful if someone could advise about the following;

    I filed the I-485, I-131 and I-765 on October 22nd 2018 (I-130 already approved).
    I then requested an expedite of the I-131 on 9th January 2019, have faxed the evidence and am awaiting the response as I need to travel. However, I have now received an interview date for February (I need to travel before this).

    I have a few questions;

    1. If I get rejected for the I-131 expedite, will having the interview stop the processing of the regular I-131 and I-765?
    2. If I get a conditional approval at the interview (as I've heard some people do), will my expedited travel permit be cancelled if it had been approved?
    3. If I get a conditional approval at the interview (as I've heard some people do), and my expedite request didn't get approved, will this stop them processing the I-131 and I-765 because my GC has been approved... even though I might still have to wait months to actually receive the physical card?
    4. I read online that if you're approved they stamp your passport with a temporary stamp allowing you to travel and work immediately. Is this old information and only applied before Trump became president?
    5. If I postpone my interview because I need to travel, will this go against me and how long do you think it'd take for another interview date, will they just send me one, not actually tell me when it is if I were to call and reschedule?
    6. For the people who ended up getting approved for their GC before their work and travel permits were processed, did it take a long time to receive the physical card?
    7. My expedite request showed that I needed to travel before the date of my interview, if I go to the interview won't they see that it clearly wasn't that crucial that I needed to travel?

    My hope was that I could try and reschedule my travel and put it out by a week or so, go to the interview and then leave with my expedited travel permit (if it were to be approved) the day after the interview. Is this something that would be possible or would they cancel the travel document?
    I really don't know what to do for the best. Please advise! Thank you

    I would seriously evaluate your travel arrangements. I would not postpone your interview. That being said I knew the day of my interview that I was approved as they sent new card being produced that evening. A week and a half later my card was delivered. once your green card is approved you will no longer need a EAD/AP card. Will they cross in the mail? Maybe. Expediting your case can take a month or longer.... Do you really need to travel?

      Thank you - I will have to try and get out of my travel plans. I just wondered, what the chances are of being approved after the interview but still not receiving the card for months, as I've heard this happen and then not have either the GC to travel or the AP. If it isn't approved on the spot, will they still go ahead with processing the AP?

        I had my Interview on the 22nd November in Oklahoma City and was leaving to go to the UK on the 15th of Dec. At the end of the interview he said he was going to approve us (received a online notification that he did the next day) and if we had any questions. I told him that I was planning on going home on the 15th Dec for Xmas and is there anything I could do if my Green card did not arrive in time. He told me to come back a week before and they could put a temporary Stamp into my Passport that would allow me to travel there and back. I cant promise that this is the case after all interviews but you should definitely ask the IO at the end of the interview. At the very least it might speed the process of him doing the paperwork and approving you. Likewise there is usually around a month gap between getting the scheduled for an interview and having it so if you haven't heard anything about your interview a week before you are meant to leave and you are not leaving for long you should be fine as long as you have your AP or another valid Visa

        Forgot to say I received my GC around 9 days after the interview. My EAD took like 7 months but I didn't expedite and I received it like a week before my interview.

          Thank you for replying - I am from the UK too!
          That's great, thank you very much. I will definitely mention it at the interview. I already have the date for the interview. Wow your AP took a long time!
          I'm jealous you got to go home for Christmas, I really wanted to!
