    Hello everyone.

    I received my EAD card in August of 2018. I started working part time in October and made about $4K. I am still waiting for my GC through the IR-5 category.
    The question is, do I have to file my income taxes? I made so little, not sure if I can get introuble if I don't file at the interview.


    My timeline:
    Petitioned by daughter who is a US citizen and we both live in the US. (IR-5 category)
    2-12-18 USCIS received my I-765 and I-485
    2-20-18 USCIS accepted my fingerprints
    3-21-18 USCIS received my response to RFE for I-485. NBC working on case
    7-30-18 USCIS sent request for Initial evidence for I-485. NBC working on case
    8-9-18 USCIS received response to RFE for I-485. NBC working on case
    8-14-18 USCIS ordered new card ? I765 EAD
    8-16-18 USCIS mailed your new card ? I765 EAD
    8/20/18 received new EAD/SS Card

    Did they take out taxes on this money? Then yes you should to get it back. I also would file to prevent any issues from not filing it is really not that difficult at that income. I think the limit is 6300 and you don't have to file as long as it wasn't taxed.

    11-15-18 I130 and I485 Approved
    11-20-18 Card Mailed

      If you only have $4,000 income for the entire 2018, no, you do not have to file income tax return for 2018 (because your income is below $12,000 for Single under 65, $24,000 Married filed Jointly, $5 Married filed separately). However, if you do file, you might be qualified for tax refund. You can use the IRS Interactive Tax Assistant tool (see link below) to determine whether you need to file income tax return.



      Personally advice, it is better that you file the income tax return if you plan to live in the US permanently. Assuming if you want to get a mortgage loan, car loan or receive social security benefits in future, having tax return filed proves that you are a good resident, are working and paying taxes.         To add on, you are fine for the interview if you don't file tax return for 2018 (just explain that your income is too low and not required for filing based on IRS income requirement). No worries.

          Do you have to? Probably not. Would it hurt? Probably not. If they took any federal taxes out of your checks, you might get a refund.
