  • Courtesy Letter: Insufficient evidence

    Received a Courtesy Letter (on scary pink RFE paper) stating that our case could not be fully adjudicated because 'all pages of Form I-693 are not present or of the same revision date'.

    Our medical forms (I-693) are definitely well over a year old by now so it could be that they are out of date or it could be that the doctor screwed up the forms. So we'll be getting new medicals asap.

    However, the letter states that I should not re-send the forms and should bring them with me to the interview *IF* I am invited to one.

    Does this mean that the medical forms are the only part of the application that needs addressing and we can expect an interview date soon? Or should I expect more RFEs to come along?

    This is my second AoS application. The first was denied due to an error from the (F#$&%?&%$&) official who asked for Supplement J which we could not submit as we were applying under the NIW which does not require a job offer. So I am very worried that this is going to happen again.

    I got my RFE for Medical I-693 on yellow paper stating ?a completed and signed I-693 was not submitted. ?
    Then it said what you mentioned above (bringing it to interiew).

    That was the only RFE I received during the process. I had received this notice on June 25, 2018. I got my combo card on December 1st along with my notice saying my interview was scheduled for January 17th, 2019.

    I think if they needed anything else from you they would have sent it along with the RFE for I-693.

      Your case likely won?t get any other RFEs and you case has probably. Even transferred to your local field office.

      How soon you get an interview depends on the processing times at your field office. It took 9-10 months after this letter for us at the New Orleans field office.

          I have not. I know the IO said it could take a couple of weeks but I find myself constantly checking anyway. I wish I could get MyUscis account to work but it won?t.

            The courtesy letter is just to remind you to get the medical done and to make sure you bring it to the interview

            Generally:
            Yellow Paper = Request For Initial Evidence (i.e. you did not submit all the required documents)
            White Paper = Request For Additional Evidence (i.e. you submitted the required documents but they need more from you because of something you did or did not put in your application)
            Pink Paper = Courtesy Letter for Medical Exam (reminding you that you need to get this done)

            When you said your last AoS was denied, do you mean that it was rejected or did they deny you after your interview or due to insufficient RFE response? I'm really sorry that happened to you. Sometimes USCIS officers do not know the law that they are supposed to be applying to cases...

            4/18: Ready to be scheduled for an interview (No notification, not updated on either site until Aug 27)
            4/19: Request to expedite EAD

              We never got to the interview. It was denied (within a week) after we responded to the RFE stating (upon advice of a lawyer) that supplement J is not required for those applying for AoS on the basis of an approved NIW as per the instructions. Lawyer said that it sometimes happens and that they had heard many denials coming out of that particular office that did not make sense. Our options were to re apply or to open an appeal. We chose the former but were told that the same could happen again: it just depends on the officer. And that initial RFE definitely came on PINK paper.

                I think I am a bit confused - You mentioned both the Pink Courtesy Letter for the I-693 (Medical) and the RFE for Supplement J. Both requests came at once? Sorry, I did not understand, I thought they came separately! Can I ask why you chose not to appeal it? I would think that a clear, strongly worded letter from a lawyer explaining the law and that the denial was in error would be sufficient. Since you are re-applying, maybe you should ask your lawyer to include a paragraph in the cover letter explaining the previous denial and laying out the law.. and hope for a different officer!

                  Major confusion! My *previous* I-485 was denied for failing to provide supplement J. We received a pink RFE for the *previous* application asking us to provide Supplement J. We responded to the RFE, noting that Supplement J is not required for those applying for AoS as self petitioners with a NIW because no job offer is required and of course quoted the relevant laws. The result was a swift denial even though we were correct and the officer was wrong.

                  Our options were to reapply or open an appeal. We decided to reapply because both processes would take the same amount of time and the lawyer said that, if we appeal, the case goes back to the *same* officer and it's unlikely that that same officer will admit their mistake and reverse their decision. At the end of the appeal process, if the decision was the same (denial) we'd need to reapply again for AoS anyway and would have wasted another year in limbo waiting for an appeal that was unlikely to be positive. So we shelled out more $$$ and reapplied (so far about $17,000 spent).

                  So, we reapplied. And I just received the pink courtesy note about the medical. I wanted to know whether we'd receive other RFEs (or whether they usually send RFEs/courtesy notes all at once. So I think we might be alright this time and the officer understands that Supp J is NOT necessary for our case if all we have received is a note about taking the medicals forms to the interview (if we get one).

                    Gotcha!! Okay yeah I had it way mixed up - Sorry!

                    Wow, I'm sorry you had to go through all of that. I think you were 100% right about re-filing, it seems like the officer you got was pretty intent on ignoring the law...

                    What I know about RFEs is that the Requests for Initial Evidence come first and on yellow usually, and the medical usually comes when you're in line for an interview but not scheduled (but I guess this is not always the case) and on pink usually, and other RFEs can come any time, usually on white (I thought - but I guess pink too!) and you can get zero or one or multiple.

                    Sounds like you're on a roll though! I will keep my fingers crossed for your smooth sailing from here on out!
