    Hello, I hope someone can answer my question. So, I married an American man about 1 year and half ago, I just got my 2 year green card. but we are having some issues, we've been going to therapy for a while, but nothing has changed, and we both understand that we will divorce at some point soon. my question is: do I lose my green card if I ask for divorce? do I have to get a lawyer for this? even knowing that our marriage is real, we were really happy, but things started not working out well.

      Hi. No you will not. However when time comes for you to remove the conditions, you have to just indicate you are filing 751 separately because of divorce( I think you tick this on the form). You indicate the circumstances surrounding your divorce. So keep proof of anything that led to divorce and also keep proof of bonafide marriage as you will need to submit those as well. Wish you all the best. This is my opinion from reading the uscis information.

        You don't have too. Make sure you keep a copy of all the evidence you used to get your green card in the first place. You will need this evidence to prove that the marriage was bonified. Next keep a copy of all banking statements and bills around the house up until you got divorced. keep a copy of all therapy you went to and save any evidence for the cause of the divorce if there is any so you can try to prove you attempted to save the marriage. Your green card will remain in affect until your removal of conditions is ruled on. Last but most important is you will need a Lawyer for the divorce and should have one prepare your package for removal of conditions. This is important for your future and you should not take chances.
