Dear All,
I had successfullyy applied for I-140 in EB1A category with your help. Now I am preparing I-485 application and we are waiting for my wife?s waiver (I do have letter from Embassy of India).
According to Jan visa bulletin the priority date is Oct 1, 2017 and it will be Feb 08, 2017 in Feb. Also, we got the sealed medical report in December and it will be void in 2 months.
I would be obliged if you could help me with a few answers
1. If I file within Jan, should it be postmarked within Jan or it should be received at USCIS facility within Jan, to be adjudicated based on Jan visa bulletin?
2. Do they send RFE for I-485 for waiver for spouse (I heard from a friend that they don?t issue RFE and reject outright if you don?t include waiver for spouse)?
3. Will it be a good idea to send in the I-485 application now (without my wife?s waiver but I can include the letter from the Embassy of India) and wait for RFE to submit the waiver?
4. Should I be applying for myself now and add spouse later when I have the waiver?
5. Should I wait till March for visa bulletin priority date to be after my priority date and file then (it may retrogress further)?
