  • RFE - when and why

    Hi guys,

    This post will have the "curiosity" tag. I have noticed that people either get and RFE right away, like 4-5 weeks after applying fro AoS or basically right before getting their combo card = like about 5 months later. Several questions:
    - Does anybody know why?
    - For those who got an RFE later, what was the reason?

    * 10/31/18 - Credit Card charged for both i-130 and i-485
    * 11/01/18 - 4 text messreceived
    * 11/06/18 - 4 NoAs in mailbox
    * 11/10/18 - Biometrics notification in the mail
    * 11/21/18 - Biometrics Appointment
    * 12/05/18 - "Fingerprint Review was Completed" i-485 and i-765
    * 02/27/19 - "Case is ready to be scheduled for an interview" i-485
    * 02/28/19 - Received the i-693 Courtesy Letter
    * 05/20/19 - 2 NoAs for i-765 and i-131 in mailbox
    * 05/22/19 - Combo Card in hand

    I think the earlier ones are a Request For Initial Evidence, where basically something they need to determine basic eligibility is missing, and then later it's a Request For Additional Evidence, which is something they need if they determine someone is eligible on the face of the application, but some evidence is weird or unclear or fishy or needs follow up to make sure that the person should be able to adjust. Like, if you don't submit your divorce decree, they may issue an RFIE for that because it's required but if you submit your divorce decree, they may send an RFE asking for proof of payment of child support even though it's not "required" right when you file because you have to show you're a good person and part of that is supporting your family.

    But that's just a thought. It's USCIS, so who knows?? I could be way off. Maybe someone else on this forum knows

      We got an RFIE right away, you can check my posts or the November Filers thread for details. Ours was for the I-864 (affidavit of support) - USCIS gives you two options for tax-related supporting evidence on that form: your own tax returns & forms OR official IRS transcripts. We got the official transcripts and sent them in. Then USCIS asked for my returns in the RFIE anyway.

      Annoying and could be related to their many new officers, but we sent them back two days after receiving the RFIE and everything went fine, we're now waiting to be scheduled for interview.
