  • Move over traffic violation - i 485

    Hello Everyone ,

    I am going to file i 485 shortly with my wife.My wife has a move over traffic violation and got a traffic ticket .

    So I have checked in yes for below I 485 question in Part 8 Section .

    Have you EVER been arrested,cited,charged,or detained for any reason by
    any law enforcement officeal ? Yes

    Have you EVER pled guilty to or been convicted of a crime or
    offense (even if the violation was subsequently expunged or
    sealed by a court or if you were granted a pardon,amnesty,
    a rehabilitation decree ,or other act of clemecy)? Yes


    Do I have to provide any documentation regarding that ?

    When I entered the questionnaire from my lawyer (who filed the I485) the question was if I had been arrested, charged, cited (excluding minor traffic violations). Therefore I answered NO to the question. During my interview the officer went through a lot of the YES/NO questions but he only asked if we had ever been arrested, not if we had ever been cited.

    At the end of the interview he asked if we had anything to add that may be relevant. At that point I disclosed my traffic citation and he answered that it was no issue and he did not even mark the form differently. I think if you mark the question YES, you do need to provide documentation as well as evidence that you paid the fine.

    FEB - 2019 - I-485 approved
    FEB - 2019 - green cards in hand 😎

      You need to mark 'yes' and provide proof of payment.
      The question excludes parking tickets, but includes moving violations.
      If you say 'no' and they ask you about it, or see it in your record, they can assume that you are dishonest or hiding something. Usually it's okay if you bring it up in the interview, because many people mess up that question and the IOs understand that not everyone knows what it means, but why give yourself the headache of being unprepared? Or they can RFE you for the record, and that's a delay in your case. Just say 'Yes' and then write a note about it and give proof.
