  • Change of project in the same company after I-140 approval-EB1

    Dear All,

    Need your advice please..

My I-140 and I-485 process started under EB1 in Jan-2018.

Now my I-140 is approved and I have EAD/AP. I-485 is pending.

As a consultant I have to change my project work location as the current project is ending soon . It will be under same employer and same role but for different client and location.

Could you please advice if there is any impact for this change in my current GC status or I have to avoid this change ?

I had a similar situation where I potentially could change jobs and I asked my lawyers. Their advice was that they would need to review the new job description to ensure if does not jeopardize the I485 application. Lawyers indicated that the role must be comparable, in my case it was important it was still executive/managerial in nature since I filed in EB1C.

I recommend you have your old and new job descriptions reviewed by your lawyers to make sure there are no issues.
