  • Priority Date Blank in I 485 receipt notice

    Hi,

    My wife filed form I 130 on february 5th 2018 under F2A category. She became US citizen on October 31st,2018. She spoke to USCIS Customer Service and upgraded our I 130 preference category from F2A to Immediate Relative and we received a new receipt notice on November 12th 2018.
    I am currently in US on H1B visa so we filed I 485 and submitted I 485, I765 and I 131 on January 24th 2019. USICS received them on 01-25-2019. I received text messages on 01-30-2019 with receipt numbers and my credit card is charged on 01-30-2019. We have received the receipt notices on 02/01/2019. The priority date on all three receipt notices is blank.
    I am wondering if anyone has experienced this situation. Do I need to call USCIS and check with them?

    I think priority dates, for people married to USC, doesn't matter. I have never read one case of people married to USC mention PD.

    PD is important for EB or FB that are limited to a Final Action Date.

    I even saw a I-485 with blank PD for EB cases that are already approved. That person filed the same forms as you (I think the second is I-765, right?), received NOA without PD and 2 weeks later she received the biometrics appointment letter. Now her online status show Fingerprint Review Was Completed.

    Edit: I just saw a couple of posts, on people's signatures, that say PD (married to USC), but I can't find if the PD is actually printed on the I-485 or not.

      Your PD is basically the date USCIS received and accepted your application. I applied through F2B category and so my PD is back in 2013 but the date my I-485 was accepted was Sep 6th. For EAD purposes, Sep 6th is my priority date. Hope that helps =)

      06/03/14 - I-130 approved
      09/01/18 - date for filing current
      09/01/18 - I-485; I-131; I-765 filed
      09/11/18 - check cashed
      09/13/18 - case electronic notice received
      09/14/18 - biometrics notice issued
      10/01/18 - biometrics appointment
      10/02/18 - fingerprint review completed
      10/22/18 - interview cancelled (it was never scheduled)
      02/12/19 - EAD card is being produced

        I agree PD is no longer relevant in the Immediate Relative category because there is no quota for this category.
        Furthermore your original PD will likely still be valid, even if not printed on a NOA.

        You can call them to inquire if it helps to reassure that the IR category makes the PD irrelevant for your case.
