Hi, I'm a derivative applicant. My husband is the primary applicant based on i140. When we file our adjustment of status paperwork, which category for EAD do I use, c(9) or c(26)? My current status is H4. There's not a backlog for his country of origin, so we will be applying for adjustment of status as soon as we get i140 approval.

Also note that if a visa number is available, you guys do not need to wait until I-140 is approved to file I-485. You guys can file I-485 together with I-140 or while I-140 is pending.

Thanks, that's what I assumed. His employer is premium processing his i140.
